1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 MARJORIE L. SORENSON ) FINAL ORDER OF REPRIMAND 6 On February 23, 2007, the Teacher Standards and Practices Commission (Commission) 7 received a report from Sandra Husk, Superintendent, Salem-Keizer Public Schools alleging a 8 failure to maintain a secure testing environment during the proctoring of a state exam. 9 After review of the matters alleged, Ms. Sorenson and the Commission agree that their 10 respective interests, together with the public interest, are best served by a stipulation to certain 11 facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Ms. Sorenson stipulates that there is sufficient evidence in 14 the Commission's files and records to support the findings of fact, conclusions of law, and order 15 set forth below. 16 By signing below, Ms. Sorenson acknowledges, understands, stipulates, and agrees to 17 the following: (i) she has been fully advised of her rights to notice and a hearing to contest the 18 findings of fact, conctusions of iaw, and order set forth below, and fully and finalty waives all 19 such rights and any rights to appeai or otherwise challenge this Stipulation of Facts, Final Order 20 of Reprimand (Stipulation and Final Order); (ti) this Stipulation and Final Order is a public 21 document and disclosed to the public by the Commission upon request; (iii) this Stipulation and 22 Final Order is contingent upon and subject to approval and adoption by the Commission. lf the 23 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. 24 Sorenson nor the Commission are bound by the terms herein; (iv) she has fully read this 25 Stipulation and Final Order, and understands it completely; (v) she voluntarily, without any force 26 or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the 27 Stipulated Final Order below; (vi) she states that no promises or representations have been 28 made to induce her to sign this Stipulation and Fina! Order; and (vii) she has consulted with an ~ Page 1 STIPULATION OF FACTS AND FiNAL ORDER OF REPRIMAND - SORENSON 1 attorney regarding this Stipulation and Final Order and has been fully advised with regard to her 2 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 3 Stipuiation and Final Order and issuance and entry of the Stipulated Final Order below. 4 STIPULATION 0F FACTS ' 5 1. Ms. Sorenson has been licensed by the Commission since February 3, 2000. Ms. 6 Sorenson currently holds a Standard Teaching License issued June 10, 2003 with 7 endorsements in basic ESOL/bilingual, standard elementary and standard Spanish. Said 8 license expires February 21, 2009. 9 2. Ms. Sorenson allowed a student from another class to assist her students with logging 10 onto the computers and other computer problems. School Administrators reported seeing that 11 student talking with her students during the testing process. 12 3. Ali testing in the school was cancelled upon discovery of the test security breach. 13 The district issued a reprimand to Ms. Sorenson for this incident. 14 lT IS SO STIPULATED AND AGREED TO: . / 15 ‘13.1:- ' i -_. Sorenson failed to adequately supervise 22 students during the administration of a state exam. This misconduct constitutes Gross Neglect 23 of Duty, pursuant to OAR 584-020-0040(4)(5)(n) as it incorporates OAR 584-020-0020(2)(d). 24 The Commission has the authority to impose discipline in this matter under ORS 342.120 25 through 342.430 and OAR Chapter 584. 26 I l l 27 / I I 28 / I l 29 / / / 30 / I I Page 2 STIPULATION OF FACTS AND FiNAL ORDER OF REPRIMAND - SORENSON 1 ORDER 2 The Commission hereby adopts and incorporates herein the above findings of fact, 3 conclusions of law and imposes a Public Reprimand upon the licensure of Marjorie L.
