I 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON i In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 CHERYL ANN COOPER ) LICENSE REVOCATION 7 8 On July 22, 2008, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Cheryl Ann Cooper (Cooper) in which the 10 Commission charged her with misconduct under ORS 342.175. The Notice was sent via U.S. 11 First Class Mail and U.S. Certified Mail Receipt 7006 2760 0000 1638 6848 to the address on 12 file with the Commission. The certified mail receipt was signed by Merle Cooper and returned to 13 the Commission on July 24, 2008. The Notice of Opportunity of Hearing, dated July 22, 2008, 14 and signed by Victoria Chamberlain, Executive Director, stated: 15 "You, Cheryl Ann Cooper, are entitled to a hearing on the proposed action of the 16 Commission. lf you want a hearing, you must file a written request for a hearing 17 with the Commission within 21 days of the date of this notice. Attached to this 18 notice is a copy of the procedures, right of representation and other rights of 19 parties relating to the conduct of a hearing as required under ORS 183.413(2).” 2(1) Ms. Cooper did not request a hearing. The Commission, therefore, finds 22 Ms. Cooper to be in default and enters the following findings of fact, conclusions of law 23 and order, based on the files and records of the Commission concerning this matter. 24 FINDINGS OF FACT 25 1. Ms. Cooper has been licensed by the Commission since July 1, 1975. The 26 Commission issued Ms. Cooper a Standard Teaching License on July 24, 2006, valid until July 27 23, 2011 with Administrative Services, Financial Services and Standard General Business 28 Education endorsements. ‘ 29 2. On July 31, 2007, Ms. Cooper pled guilty to five counts of aggravated theft in I 30 connection with your embezzlement of funds belonging to the Reynolds Education Association 31 while you were treasurer. As a result of the convictions, Ms. Cooper was placed on supervised 32 probation for 60 months and ordered to pay $99,585.30 in restitution to the Reynolds Education PAGE 1 - DEFAULT ORDER OF LICENSE REVOCATION - CHERYL ANN COOPER 1 Association. 2 3. On November 8, 2006, Commission investigators contacted Ms. Cooper via regular 3 mail and certified mail to arrange a time for an Interview regarding the conduct above. Ms. 4 Cooper did not respond t0 letters and has not submitted to an investigative interview. 5 CONCLUSIONS OF LAW g Cooper's conviction of five counts of Aggravated Theft, a class B felony, violates OAR 8 584-020-0040(5)(c), OAR 584-020-0040(3)(a), OAR 584-020-0040(4)(o) as in incorporates 584- 9 020-0035(3)(a), and OAR 584-0040(4)(n).
