1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION Q OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 PATRICIA KAREN NAGLAK ) FINAL ORDER OF REPRIMAND 6 On June 17, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from Steve Chiovarc, Superintendent, YamhiII-Carlton School District alleging 8 that Patricia Karen Naglak (Naglak) fatsitied student credit reports in a credit recovew program. 9 Ms. Naglak fully cooperated with the Commission's investigation. After review of the 1O matters alleged, Ms. Naglak and the Commission agree that their respective interests, together 1 1 with the public interest, are best served by a stipulation to certain facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Ms. Naglak stipulates that there is sufficient evidence in the 14 Commission‘s files and records to support the findings of fact, conclusions of law, and order set .> forth below. 16 By signing below, Ms. Naglak acknowledges, understands, stipulates, and agrees to the 17 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 1 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all ‘ 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order 0t Reprimand (Stipulation and Final Order); (ii) this Stipulation and Finai Order is a public 21 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 22 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 23 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms. 24 Naglak nor the Commission are bound by the terms herein; (iv) she has tuily read this 25 Stipulation and Finai Order, and understands it completely; (v) she voluntarin, without any force 26 or duress, enters into this Stiputation and Finai Order and consents to issuance and entry of the . Stipulated Final Order below; (vi) she states that no promises or representation has been made Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - NAGLAK 1 to induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an Q attorney regarding this Stipulation and Final Order and has been fully advised with regard to her 3 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 4 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 5 STIPULATION 0F FACTS 6 1. The Commission has licensed Patricia Karen Naglak since July 7, 1978. Ms. Naglak 7 currently holds a Standard Teaching License valid May 12, 2004, through June 14, 2009, with 8 endorsements in Basic Elementary and Standard Music. 9 2. Ms. Naglak began employment with the Yamhill-Carlton School District in August of 1O 1994. During the 2004-2005 school year Ms. Naglak served halftime (.5 FTE) as a teacher at 1 1 the high school in a credit recovery/alternative education program. 12 3. Without the knowledge of administration or approval by Credit Recovery Contract 13 Ms. Naglak assigned and granted .5 credit to two different high school students for coursework Q within a few days of the YamhiII-Carlton High School 2004-2005 graduation ceremony. The 15 assignments Ms. Naglak negotiated with the students for credit were not appropriate for the 16 credit granted. 17 4. The YamhiII~CarIton School District does not have written policies or procedures for 18 the Yamhill-Carlton High School Credit Recovery Program. 19 IT IS SO STIPULATED AND AGREED T0: 2O 21 W flZ ”£0é______ 22 Patricia Karen Naglak D e 23 .»" 24 M /&’5T0é 25 Victoria Cha e , xecutive Director Date 26 Teacher Standards and Practices Commission g / / / Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - NAGLAK 1 CONCLUSION OF LAW Q During the last week of the 2004-2005 school year Patricia Karen Naglak inappropriately 3 granted credit to students to meet graduation requirements without administrative authorization. 4 Ms. Naglak’s failure to demonstrate a commitment to use professional judgment constitutes 5 gross neglect of duty in violation of OAR 584~020-0040(4)(n) as it incorporates OAR 584-020- 6 0010(5).
