1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION If’ g OF THE STATE OF OREGON g In the Matter of the l 6 Teaching License of | STIPULATION OF FACTS, 7 GREGORY WAYNE ROGERS | ORDER OF REPRIMAND AND 8 I PROBATION 9 10 On or about April 5, 2001, the Teacher Standards and Practices Commission 11 (Commission) received a report from David Davis, Superintendent for Klamath County 12 School District indicating that Gregory Wayne Rogers (Rogers) had been arrested on a 13 charge of harassment. Court records reveal that or about March 18, 2001, Mr. Rogers 14 was arrested in Klamath Falls, Oregon for Assault IV on his wife. On April 30, 2001, he 15 pled guilty to two charges of Harassment (offensive physical contact) and was convicted 16 in Circuit Court for Klamath County. ,- "17 After review of the facts in this matter, Mr. Rogers and the Executive Director 18 agree that their respective interests, together with the public interest, are best served by 19 a stipulation to certain facts, a Reprimand followed by a Probation of two (2) years. This A 20 Order sets forth the facts upon which the parties have agreed and the sanction to be 21 imposed. In entering into this stipulation, Mr. Rogers waives the right to a hearing to 22 contest the findings of fact, conclusion of law and order set forth below. Mr. Rogers 23 understands that the Commission will impose a two (2) year probation with specific 24 conditions. 25 This stipulation is contingent upon approval and adoption of the Order by the 26 Commission. If the Commission does not adopt this Order, neither Mr. Rogers nor the 27 Commission arebound by these Stipulations and Mr. Rogers retains all rights to a ‘28 hearing on the allegations. ' , Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION ‘J 1 FINDINGS 0F FACT . 2 1. Mr. Rogers holds a Basic TeachinggLicense issued on September 8, 1998 valid until 3 August 4, 2002. 4 2. Mr. Rogers is employed by the Klamath County School District as a Math Teacher at 5 Brixner Junior High School. 6 3. On or about April 30, 2001, Gregory Rogers was convicted of two counts of the 7 misdemeanor crime of Harassment, ORS 166.065, in Klamath County Circuit Court 8 (case #01-766CR). The Court sentenced Mr. Rogers to two days in jail (credit for 9 time served), 32 hours public service, placed him on 12 months supervised 1O probation, fined him $624.00 and required evaluation and counseling/treatment 11 Domestic Violence and substance abuse. 12 4. On or about March 5, 1987, Gregory Mr. Rogers pied guilty and was granted .13 Diversion for conviction of DUII. Mr. Rogers completed the Diversion program on 14 March 27 1989. Mr. Rogers is currently enrolled in a 52 week program for Anger-Management with 17 The Victim's Prevention Program of Klamath Falls, Oregon. Myton, Execu ive Director ‘ Date O Page 2 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION 1 . 2 CONCLUSION OF LAW 3 Gregory Wayne Rogers’ criminal convictions for ORS 166.065, Harassment 4 constitute gross unfitness as defined in OAR 580-020-0040(5)(c). 5 ORDER 6 The Commission adopts the above Findings of Fact and orders a Public 7 Reprimand for conviction of the crimes of Harassment as defined by ORS 166.065. This 8 Order shali serve as the Pubiic Reprimand. The Commission places Gregory Wayne 9 Rogers on probation for two (2) year to commence November 16, 2001, subject to the 10 following special conditions of probation: 11 a. Mr. Rogers shall be evaluated substance abuse, comply with 12 counseling/treatment, at his own expense, and provide a copy of the .13 evaluation and treatment plan to the Executive Director within thirty (30) days 14 from the date of this Order; 15 b. Mr. Rogers shall participate in and successfully complete an Anpggzc§+'\c’ 16 Wrogram for the modification of his behavior at his own expense; 17 c. Rogers shall conduct himself as a law-abiding citizen; 18 d. Rogers shall report in writing within ten days to the Executive Director of the 19 Commission any arrest or citation for any felony, misdemeanor, or major 20 traffic violation; and 21 e. Rogers shall comply with the Standards for Competent and Ethical 22 Performance of Oregon Educators under OAR Chapter 584, Division 20.
