1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON In the Matter of the ) 3 Teaching License of ) ) STIPULATION AND ORDER 4 TRACY REAGAN ) OF SUSPENSION 5 —) 6 On July 20, 1999, the Teacher Standards and Practices Commission (Commission) issued 7 a Notice of Opportunity for Hearing to Tracy Reagan. Thereafter, Ms. Reagan requested a 8 hearing through her Attorney, John Bishop. The Commission and Ms‘ Reagan have now 9 reviewed the issues connected with this proceeding and have determined that their respective 10 interests and the public interest are best served by a stipulation to certain facts and a suspension 11 of Ms. Reagan's Oregon Teaching License, followed by a period of probation. Ms. Reagan 12 understands that in entering this stipulation she is waiving her right to a hearing, and the 13 Commission will enter a suspension of her teaching license. She further understands that upon 14 reinstatement of her license, she will be placed on probation subject to specific conditions. 15 STIPULATED FACTS 16 Ms. Reagan and the Commission stipulate as follows: 17 11 Ms. Reagan holds a Basic Oregon Teaching License with an endorsement in . l8 elementary education. During the 1998-99 school year, she was employed as a kindergarten 19 teacher at May Roberts Elementary School in the Ontario School District. 20 2. In February 1999, 0n more than one occasion, Ms. Reagan consumed alcohol 21 while on duty as a teacher. As a result, the School District placed her on administrative leave 22 pending disciplinary action. On March 30, 1999, MS. Reagan entered a 30-day in-patient alcohol treatment 2 program in Baker City, Oregon. She successfully completed the program and was 3 discharged on April 30, 1999. 4 4. Ms. Reagan acknowledges that she suffers from alcoholism. She reports that she 5 has attended Alcoholics Anonymous meetings regularly since her discharge from the in-patient 6 treatment program. Myton Date Executive Director 11 Teacher Standards and Practices Commission 12 13 CONCLUSION OF LAW . l4 Tracy Reagan violated OAR 584-020-0040(4)(g) by appearing on duty at her school 15 while under the influence of alcohol. 16 ' DISCUSSION 17 Ms. Reagan's conduct was unacceptable. It could have placed the safety of her students 18 in jeopardy and could have damaged the reputation of her school within the community. To her 19 credit, Ms. Reagan has acknowledged her alcoholism and has taken steps to keep it under 20 control. A suspension followed by a period of probation is an appropriate sanction that will give 21 MS. Reagan the opportunity to become a successful teacher. 22 ORDER 23 The Oregon Teaching License of Tracy Reagan shall be suspended for a period of ninety 24 days from the date of this order. At the expiration of the period of suspension, Ms. Reagan's 25 teaching license shall be reinstated upon her application and a showing that she has entered into a . 26 treatment plan at her own expense with a qualified alcohol/drug treatment provider that is Page 2 - STIPULATION AND ORDER OF SUSPENSION JGM/CfS/GEN38322.DOC Department of Justice 1162 Court Street NE Salem, 0R 97310 (503) 378-6003 ’ 1 acceptable t0 the Commission. She shall provide a copy of the treatment plan to the 2 Commission. The treatment plan shall continue for two years or for as long as recommended by 3 the treatment provider. It Shall contain the following elements: 4 a. Regular contact with a counselor and/or group therapy at least two times 5 per month and 6 b. Random urinalysis/breathalyzer tests to be conducted by the treatment 7 provider on at least a quarterly basis. 8 Following reinstatement of her license, Ms. Reagan shall be placed on probation for a 9 period of four years subject to the following conditions: 10 1. MS. Reagan Shall meet all requirements of the treatment plan of the qualified 1 1 alcohol/drug treatment provider. 12 2. MS. Reagan shall provide the treatment provider with a copy of this order and 13 shall sign all necessary documents and releases to permit the provider to communicate with the ' 14 Commission about Ms. Reagan’s progress and treatment. Ms. Reagan shall direct the treatment 15 provider to contact the Commission if Ms. Reagan fails to participate satisfactorily in the I6 treatment program, including the requirements to attend meetings and to submit to 17 UA/Breathalyzer testing. 18 3. MS. Reagan shall direct the treatment provider to send written reports to the 19 Commission ost. Reagan's progress in the treatment program. with the first report to be 20 provided by September 1, 2000 and follow up reports by March l, 2001; September 1, 2001 and 21 a final report March l, 2002. MS. Reagan shall pay the costs of the reports. 22 4. During the entire period of probation, MS. Reagan shall not consume alcohol or 23 controlled substances, except as prescribed by a physician. 24 5.
