OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REPRIMAND 2 JEFFRY ALAN DAVIS ) AND PROBATION 7 On or about November 22, 2002, the Teacher Standards and Practices Commission 8 (Commission) received a report from Bonnie Webber, Director of Human Resources, Oregon 9 City Public Schools indicating that Jeffry Alan Davis (Davis) appeared at two district sponsored 10 events after consuming alcoholic beverages. i 11 After review of the matters alleged, Mr. Davis and the Commission agree that their TI 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts, the imposition of a Public Reprimand and a four (4) year probation. This Order sets forth 14 the facts upon which the parties have agreed and the sanction to be imposed. Mr. Davis 15 stipulates that there are sufficient facts contained in the Commission's files and records to ‘ support the findings of fact and conclusions of law set forth below. In entering into this 17 stipulation, Mr. Davis waives the right to a hearing to contest the findings of fact, conclusion of 18 law and order set forth below. Mr. Davis understands that the probation will be subject to 19 specific conditions. I 20 STIPULATION OF FACTS 21 1. The Commission has licensed Jeffry Alan Davis since January 5, 1977. Mr. Davis 22 currently holds a Standard Administrative License valid May 21, 2001, through May 24, 2006, 23 with a Standard Administrator Endorsement. 24 2. Mr. Davis has served as an Athletic Director/Assistant Principal for Oregon City 25 Public Schools since August of 1998. Mr. Davis resigned his employment with the District 26 effective June 30, 2003. 27 3. Mr. Davis appeared at two district sponsored events (away football games) after , . consuming alcoholic beverages on October 4, 2002, and October 10, 2002. Page 1 — STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION — DAVIS 1 4. Mr. Davis enrolled in a 12-week outpatient treatment program at CareMark, Meridian ‘ Park Hospital on February 6, 2003. I 3 5. Mr. Davis recognizes that he has an alcohol dependency problem and has agreed to 4 a plan of treatment and aftercare as prescribed by his treatment provider. 5 Jeffry Alan Davis enters into this Stipulation of Facts with the knowledge that the 6 Teacher Standards and Practices Commission shall place his on probation for a period of four 7 (4) years. This Stipulation is contingent upon approval and adoption of the Order by the full 8 Commission. The Commission's authority to impose 21 discipline in this matter is based upon ORS 342.175. 22 ORDER 23 The Commission imposes a Public Reprimand on Mr. Davis. This Stipulation of Facts, 24 Order and Probation constitutes the Reprimand. Furthermore, the Commission imposes a four 25 (4) year probation upon Mr. Davis subject to the following conditions. 26 The terms of probation are as follows: 27 1. Mr. Davis shall, at his own initiative and expense, continue to obtain treatment for his ’ alcohol dependency as recommended by his alcohol treatment provider; Page 2 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION < DAVIS 1 2. During the period of his probation, Mr. Davis shall submit to the Executive Director of . the Commission reports of his compliance with the treatment plan. Mr. Davis shall provide 3 these reports every six (6) months during his probation; 4 3. Mr. Davis shall comply with all Standards for Competent and Ethical Performance 5 under Oregon Administrative Rules Chapter 584, Division 020. 6 If Mr. Davis does not comply with his treatment plan based on the reports of his 7 treatment provider or as othen/vise determined by the Executive Director he shall be in violation 8 of the terms of this probation.
