9 On July 20, 2005, the Teacher Standards and Practices Commission (Commission)
10 issued a Notice of Opportunity for Hearing to Mark Joseph Haevers (Haevers) in which the
ll Commission charged him with conviction of crimes listed in ORS 342.143(3). The Notice was
12 sent via U.S. First Class Mail and U.S. Certified Mail Receipt #7005 0390 0000 5019 1752 to
I3 the address obtained by the Commission. The U.S. Certified Mailing receipt was not returned to
I4 the Commission. The U.S. First Class Mailing and U.S. Certified envelopes were not returned
|5 to the Commission are assumed delivered. The Notice of Opportunity of Hearing, dated
16 July 19, 2005, and signed by Victoria Chamberlain, Executive Director, stated: .
17 "You, Mark Joseph Haevers, are entitled to a hearing on the proposed action of
Q the Commission. If you want a hearing, you must file a written request for a
hearing with the Commission within 21 days of the date of this notice. Attached
20 to this notice is a copy of the procedures, right of representation and other rights
21 of parties relating to the conduct of a hearing as required under ORS
22 183.413(2).”

24 Mr. Haevers did not request a hearing. The Commission, therefore, finds
25 Mr. Haevers to be in default and enters the following findings of fact, conclusions of law
26 and order, based on the files and records of the Commission concerning this matter.
27 FINDINGS OF FACT
28 1. Mr. Haevers has been licensed by the Commission since July 1, 1974. Mr. Haevers
29 currently holds a Basic Teaching License issued November 8, 2004, valid until November 5,
30 2007, With Endorsements in Basic Elementary, Basic ESOL, and Basic Reading.

1 2. Mr. Haevers began employment with Woodburn School District as a licensed teacher
' on August 29, 1983. Mr. Haevers‘ employment with the District was terminated on or about
3 March 17, 2005.
4 3. On July 1, 2005, Mark Joseph Haevers pied guilty and was convicted of Sex Abuse
5 in the First Degree, ORS 163.427, in the Circuit Court of the State of Oregon for the County of
o Marion. The court sentenced Mr. Haevers to 75 months in the custody of the Department of
7 Corrections, 45 months post-prison supervision and required Mr. Haevers to register as a sex
8 offender.
9 CONCLUSIONS OF LAW
10 Mark Joseph Haevers’ conviction for Sex Abuse in the First Degree, as defined by ORS
11 163.427 is listed in ORS 342.143(3). The Commission is required to revoke the Basic Teaching
I2 License issued to Mr. Haevers and revoke his right to appiy for a license pursuant to ORS
13 342.175(2). The Commission's authority to impose discipline in this matter is based upon ORS
. 342.175.
15 ORDER
16 The Commission hereby revokes the Basic Teaching License issued to Mark Joseph
17 Haevers and revokes his right to apply for a teaching license.
