WHEELER I OF REVOCATION 8 | 9 ~ lO 11 On October 12, 2001, the Teacher Standards and Practices Commission issued a 12 Notice of Opportunity for Hearing to Nate J. Wheeler, in which the Commission proposed to 13 suspend or revoke the teaching license of Nate J. Wheeler or otherwise impose discipline 14 under ORS 342.177. The notice was sent via U.S. First Class Mail and U.S. Certified Mail 15 Receipt #7000 0600 0023 8496 9716 to the address Mr. Wheeler provided to the 16 Commission. The certified mail receipt was signed and dated by Shirley Wheeler on October 17 l3, 2001, and returned to the Commission on October 15, 2001. Nate Wheeler did not 18 request a hearing. . 19 '20 The Notice of Opportunity for Hearing, signed by David V. Myten, Executive 21 Director, stated: 22 If a request for hearing is not received within this 21-day period, your right to 23 hearing shall be considered waived unless your failure to request a hearing was 24 beyond your reasonable control. If you do no request a hearing or if you fail to 25 appear at a hearing, the Commission will adopt an Order of Default which may 26 include the revocation or suspension of your license or other discipline. 27 28 Based on the foregoing, the Commission finds Nate J. Wheeler in default and such 29 default is hereby entered. Based on the records and files of the Commission, the 30 Commission enters the following findings of fact and order. Wheeler holds an Initial Teaching License with endorsements in Early 4 Childhood Authorization, Elementary Authorization Level and Multiple Subject Self- 5 Contained valid through December 30, 2002. 6 7 2. Nate J. Wheeler was employed in the Hillsboro School District as a substitute 8 teacher. Mr. Wheeler tendered his resignation on February 9, 2001. 9 10 3. On July 19, 2001, the Washington County Circuit Court convicted Nate Justin 11 Wheeler on charges of: i 12 ORS 163.415 — Sexual Abuse in the Third Degree 13 ORS 475.999 — Delivery of a Controlled Substance within 1,000 feet of a School 14 1 5 .16 CONCLUSIONS OF LAW 17 18 The Commission is required under ORS 342.175(2) and OAR 584-020-0040(1) to 19 revoke the teaching license of any person convicted of a violation of ORS 163.415 or 20 475.999. v 21 22 ORDER 23 ' 24 The Commission revokes the Initial Teaching License #308770 issued to Nate Justin 25 Wheeler, DOB 12-30-72.
