.\ 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 1 } 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND g SANDRA KAY ELSEA g ORDER OF REPRlMAND 7 On or about August 24, 2001, the Teacher Standards and Practices Commission 8 (Commission) received a complaint from Richard Elsea, former spouse, alleging that Sandra 9 Elsea furnished alcohol to students. On October 8, 2001, Richard Elsea telephoned the 10 Commission to report that Sandra Elsea furnished alcohol to minors by purchasing a keg of 11 beer. 12 Ms. Elsea fully cooperated with the Commission's investigation. After review of the 13 matters alleged, Ms. Elsea and the Commission agree that their respective interests, together 14 with the public interest, are best served by a stipulation to certain facts and the imposition of a ( "15 Public Reprimand. This Order sets forth the facts upon which the parties have agreed and the 16 sanction to be imposed. In entering into this stipulation, Ms. Elsea waives the right to a hearing 17 to contest the findings of fact, conclusion of law and order set forth below. I 18 STIPULATION OF FACTS 19 1. Ms. Elsea holds a Basic Oregon Teaching License with Basic Mathematics and Basic 20 Elementary Endorsements issued on February 2, 2001 valid until July 12, 2004. She has been 21 licensed by the Commission since 1992 there are no prior complaints on file. 22 2. Ms. Elsea is employed by Mitchell School District as a Mathematics Teacher at 23 Mitchell High School. She beginning her employment in 1998. 24 3. In March of 2000, during spring break, Ms. Elsea allowed foreign exchange students 25 in her care to consume alcohol in her presence in San Francisco, California. On September 17, 2001, Mitchell School . 2 Superintendent, Mike Carroll, reprimanded her for this behavior. 3 4. In November of 2000, during the Thanksgiving holiday weekend, Ms. Elsea 4 purchased a keg of beer for a party hosted by her sons (ages 18 and 21) in Bend, Oregon. Ms. 5 Elsea was aware that minors would consume the alcohol she purchased. Ms. Elsea admits to 6 furnishing the alcohol in exchange for a promise from her son that nobody would be permitted 7 to drink and drive during the weekend. 8 5. Ms. Elsea accepts responsibility for her behavior and acknowledges his behavior was 9 inappropriate. . I 1O This stipulation is contingent upon approval and adoption ofthe Order by the 11 Commission. By furnishing alcohol to 25 minors in Bend, Oregon Ms. Elsea violated Oregon State Law and OAR 584-020-0040(5)(e) ' 26 Gross Unfitness.
