1 STATE OF OREGON ‘ 2 TEACHER STANDARDS AND PRACTICES COMMISSION 3 In the Matter of the ) Teaching License of ) STIPULATION, PUBLIC 4 AMY ANN BAUER ) REPRIMAND AND ORDER OF ' ) PROBATION 5 I 6 On December 2, 1997, the Teacher Standards and Practices 7 Commission (Commission) issued a Notice of Opportunity for 8 Hearing to Amy Ann Bauer (Ms. Bauer). Ms. Bauer requested a 9 hearing to contest the allegation in the Notice. After a review 10 of the matters alleged, the parties have agreed their respective 11 interests, together with the public interest, are best served by 12 a Stipulation to certain facts, a public reprimand, and order of 13 probation. This agreement sets forth the facts upon which the ‘ l4 parties have agreed, the sanction to be imposed, and the 15 Commission's Order. 16 In entering this Stipulation, Ms. Bauer understands that she 17 is waiving her right to a hearing and further understands that 18 the Commission will impose the sanctions set forth below. This 19 Stipulation and Proposed Order is subject to review and approval 20 by the full Commission. Ms. Bauer holds a Standard Teaching License with 4 endorsements in Language Arts and Social Studies. . 5 2. On March 6, 1997, Ms. Bauer was assigned as a 6 substitute teacher for a fourth grade class at Gaffney Lane 7 Elementary School in the Oregon City school district. 8 3. On the above date, at about the time of the lunch 9 recess, Ms. Bauer responded inappropriately towards a student who 10 had left the lunch room area without permission. Ms. Bauer 11 reprimanded the student in an overly harsh and overly emotionally 12 manner that tended to escalate rather than ameliorate the '13 situation. In her interaction with the student, Ms. Bauer .14 grasped the student by the arm in a manner that was 15 inappropriate, especially when considered in combination with Ms. 16 Bauer's words and demeanor. l7 4. Ms. Bauer was employed as an eighth grade teacher with 18 the Sheridan School District from the fall of 1994 until February 19 3, 1995, when she resigned from her position with the district. 20 At the time of her resignation, Ms. Bauer had been placed on a 21 plan of assistance and her position with the district was under 22 close review for unsatisfactory performance. 23 5. Ms. Bauer violated OAR 584-020-0020(2) (d) and 584-020- 12 0025(2) (a) in her interactions with a fourth grade student on '13 March 6, 1997. ‘14 2. Ms. Bauer violated OAR 584-020-0040 by providing false 15 or misleading information on her 1996 application for renewal of 16 her Oregon Teaching License. 17 DISCUSSION 18 Ms. Bauer acted excessively and inappropriately in her 19 interactions with a fourth grade student when Ms. Bauer was 2O working as a substitute teacher for the Oregon City School 21 District. Ms. Bauer also submitted materially inaccurate 22 information to the Commission concerning the circumstances under 23 which she resigned her position with the Sheridan School 24 District. In imposing a sanction, the Commission takes into 25 account that'Ms. Bauer is a relatively new teacher, and that she 26 is currently employed in a teaching position. Salem, Oregon 91310 (503)373-6003 ‘1 considerations, the Commission will impose a public reprimand and '2 period of probation. 3 ORDER 4 The Commission imposes a public reprimand, and this order 5 shall serve as the public reprimand. The Commission also places 6 Amy Ann Bauer on probation for a period of two years from the 7 date of this order. Ms. Bauer's probation shall be subject to 8 the conditions that she obey all laws and comply with all 9 standards for Competent and Ethical Performance of Oregon 10 Educators under OAR 584, Division 20.
