.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter 01 the ) STIPULATION OF FACTS, 4 Teaching License of ) SURRENDER, AND ORDER OF 5 MARJORIE JANE BUSH ) REVOCATION 6 On or about May 13, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from BJ Hollensteiner, Superintendent, North Santiam School 8 District, alleging that Marjorie Jane Bush (Bush) neglected to respond “yes” to the question 9 “Have you ever had a license denied or revoked" on her application for employment. 10 After review of the matters alleged, Ms. Bush and the Commission agree that their 11 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts and surrender of her teaching license as per OAR 584-050-0027. 13 This Order sets forth the facts upon which the parties have agreed and the sanction to 4 be imposed. Ms. Bush stipulates that there are sufficient facts contained in the Commissions Q files and records to support the findings of fact and conclusions of law set forth below. In 16 entering into this stipulation, Ms. Bush waives the right to a hearing to contest the findings of 17 fact, conclusions of law and order set forth below. Ms. Bush understands that the Commission 18 will revoke her teaching license. 19 This stipulation is contingent upon approval and adoption of the Order by the 20 Commission. If the Commission does not adopt this Order, neither Ms. Bush nor the 21 Commission are bound by these Stipulations and Ms. Bush retains all rights to a hearing on the 22 allegations. 23 STIPULATION OF FACTS 24 1. On July 14, 1998, the Commission adopted a Stipulation of Facts and Order of 25 Surrender and Revocation of a Three-Year Professional Technical License issued to Marjorie 26 Jane Bush for multiple theft convictions and failure to disclose criminal convictions on an ./ application for renewal of licensure. Page 1 STIPULATION OF FACTS, SURRENDER AND ORDER OF REVOCATION - BUSH 1 2. On December 20, 2000, Ms. Bush submitted an application for reinstatement of a .2 revoked license. By letter dated April 19, 2001, the Commission denied Ms. Bush's application 3 for reinstatement. Ms. Bush requested a hearing in the matter. On August 15, 2001, Ms. Bush 4 withdrew her request for a hearing. On January 11, 2002, the Commission adopted a final 5 Order by default denying the reinstatement of Licensure for Ms. Bush. 6 3. On June 20, 2002, the former Executive Director issued Ms. Bush a Substitute 7 Teaching License valid until February 18, 2006, as she did not meet recent educational 8 experience requirements for reinstatement of a Professional Technical License. 9 4. On January 14, 2003, the Commission issued Ms. Bush an Initial Teaching License 1O valid until February 18, 2006. 11 5. On or about June 28, 2004, Ms. Bush submitted an Oregon Statewide Teacher 12 Application via edzapp.com to the North Santiam School District. Ms. Bush responded “no” to ‘3 all character questions except number 8, “Have you ever been convicted or been granted .4 conditional discharge by any court for: (a) felony; (b) misdemeanor; or (c) any major traffic 15 violation...?" and number 10, “Have you ever entered a plea of guilty or No Contest relative to 16 any charge for an offense listed in question (8)?” The character questions are identical to the 17 character questions as listed on the Commission’s Application For Educator License Form C-1. 18 In addition to character questions 8 & 10, Ms. Bush should have responded affirmatively to 19 questions 1, 3, 4, 5 and 7. 2O 6. On or about August 10, 2005, Ms. Bush submitted an Oregon Statewide Teacher 21 Application via edzapp.com to the Clackamas Educational Service District for employment. Ms. 22 Bush responded “no” to all character questions except number 8, “Have you ever been 23 convicted or been granted conditional discharge by any court for: (a) felony; (b) misdemeanor; 24 or (c) any major traffic violation..." The character questions are identical to the character 25 questions as listed on the Commission's Application For Educator License Form C—1. ln O Page 2 STIPULATION OF FACTS, SURRENDER AND ORDER OF REVOCATION - BUSH 1 addition to character question number 8, Ms. Bush should have responded affirmatively to '2 questions 1, 3, 4, 5, 7 and 10. 3 7. Additional Information from the Clackamas Education Service District indicates that 4 Ms. Bush misrepresented application materials submitted on or about August 10, 2005, by 5 providing copies of letters of recommendation from North Clackamas School District Principals 6 .Gail Hayes and Jay Crystal upon which the dates had been altered from 2002 to 2005. 7 8. On an application for employment with Clackamas County ESD dated July 20, 2004, 8 Ms. Bush indicated that she held the position of “Educational Instructor’ while employed by 9 North Clackamas School District from 2000 to 2003. On an application submitted to Clackamas 1O ESD in July of 2005, Ms. Bush reported that she held a position titled “Technology Specialist" in 11 the North Clackamas School District from January 2000 through December 2002. This I 4 misconduct constitutes Gross Neglect of Duty. The Commission’s authority to impose discipline 5 in this matter is based upon ORS 342.175. I 6 ORDER 7 The Commission adopts the foregoing Stipulation of Facts and revokes the Initial 8 Teaching License of Marjorie Jane Bush.
