OF THE STATE OF OREGON 3 ln the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REPRIMAND AND g DAVID COLEMAN PARSONS ) PROBATION 7 On or about April 29, 2002, the Teacher Standards and Practices Commission 8 (Commission) received a report from Dennis Carter, Superintendent, Ontario School District 9 indicating that David Coleman Parsons (Parsons) failed to maintain proper boundaries for 1O physical contact between a teacher and his students. 11 Mr. Parsons fully cooperated with the Commission's investigation. After review of the 12 facts in this matter, Mr. Parsons and the Executive Director agree that their respective interests, _ 13 together with the public interest, are best served by a stipulation to certain facts, and a 14 Reprimand followed by Probation of two (2) years. 15 This Order sets forth the facts upon which the parties have agreed and the sanction to Q be imposed. Mr. Parsons stipulates that there are sufficient facts contained in the 17 Commission's files and records to support the findings of fact and conclusions of law set forth 18 below. In entering into this stipulation, Mr. Parsons waives the right to a hearing to contest the 19 findings of fact, conclusion of law and order set forth below. Mr. Parsons understands that the 2O Commission will impose a two (2) year probation with specific conditions. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Parsons nor the 23 Commission are bound by these Stipulations and Mr. Parsons retains all rights to a hearing on 24 the allegations. 25 STIPULATION OF FACTS 26 1. Mr. Parsons holds a Standard Teaching License issued September 26, 2000, valid until 27 September 14, 2005, with endorsements in Basic Physical Education and Basic Health ' Education. He has served the District as a teacher since 1991. 3 34 During a school sponsored wrestling meet in Coos Bay, February 28, through March 3, 4 1996, Mr. Parsons exhibited unprofessional behavior in his consumption of alcohol Mm 5 purchase of alcohol for a minor. 6 4. During the 2001-2002 school year at Ontario High School several female students 7 reported that Mr. Parsons engaged in physical contact with them. The female students reported 8 that Parsons behavior made them feel uncomfortable. The students reported that Parsons 9 hugged them, massaged their upper and lower back, poked them in the back, and purposely ran 1O into them in the hallway. This conduct took place in front of students and staff. 11 lT IS SO S ULATED: 12 M it; 13 Davi Coleman Parsons Date 14 W 3'/!'Q3 Q ictoria Cha ain, Executi e Director Date 17 CONCLUSION OF LAW 18 David Coleman Parsons’ conduct towards female students at Ontario High School 19 violated OAR 584-020-0040(4)(f), by creating an intimidating, hostile, and offensive educational 2O environment. David Coleman Parsons violated OAR 584-020-0040(4)(g) when he purchased 21 and consumed alcoholic beverages for and with a minor during a school sponsored event. This 22 conduct constitutes Gross Neglect of Duty. The Commission's authority to impose discipline in 23 this matter is based upon ORS 342.175. . 24 ORDER 25 The Commission adopts the above Stipulation of Facts and imposes a Public Reprimand 26 on David Coleman Parsons. This Order shall serve as the Public Reprimand. 27 The Commission places Mr. Parsons on Probation for a period of two (2) years to l . commence May 9, 2003, subject to the following terms and conditions: 1 Page 2 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION-PARSONS 1 a. Mr. Parsons shall conduct himself as a law-abiding citizen; ‘ b. Mr. Parsons shall report in writing within ten days to the Executive Director of the 3 Commission any arrest or citation for any felony, misdemeanor, or major traffic violation; 4 c. Mr. Parsons shall comply with the Standards for Competent and Ethical Performance 5 of Oregon Educators pursuant to Oregon Administrative Rules Chapter 584, Division 020; and 6 d. Mr. Parsons shall provide documentation that he has completed (at his own 7 expense), an intensive education program regarding appropriate boundaries with students, 8 including sexual harassment education conducted by Dwight D. Mowry, Ph.D., as approved by 9 the Commission. This intensive training shall consist of, at least, twelve (12) contact hours. 10 The Commission shall provide Dr. Mowry with a copy of this Order.
