1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION 5 DEAN WILLIAM MAREK ) 6 On or about April 4, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from Forrest Bell, Superintendent, Central School District, 8 alleging that the District recently conducted an investigation of and non-renewed Dean William 9 Marek (Marek) based on parent and student complaints alleging inappropriate relationships with 10 female students. 11 After review of the matters alleged, Mr. Marek and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts and a thirty (30) day suspension. 14 This Order sets forth the facts upon which the parties have agreed and the sanction to 15 be imposed. Mr. Marek stipulates that there are sufficient facts contained in the Commission’s 16 files and records to support the findings of fact and conclusion of law set forth below. ln 17 entering into this stipulation, Mr. Marek waives the right to a hearing to contest the findings of 18 fact, conclusions of law and order set forth below. This stipulation is entered into based solely 19 for proceedings before the Commission and on the Commission's standards established by rule 2O and statute pursuant to ORS 342.175 through ORS 342.180. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. lf the Commission does not adopt this Order, neither Mr. Marek nor the 23 Commission are bound by these Stipulations and Mr. Marek retains all rights to a hearing on the 24 allegations. Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - MAREK 1 STIPULATION OF FACTS 2 1. Mr. Marek has been licensed by the Commission since April 11, 1977. Mr. Marek 3 holds a Standard Teaching License issued March 1, 2004, valid through March 1, 2009, with a 4 Standard Art endorsement. 5 2. Mr. Marek used his school computer for personal purposes while employed at the 6 Glide and Central School Districts. 7 3. On at least one occasion during the 2001-2002 school year at Glide High 8 School, Mr. Marek referred t0 one or more female students as "hon" or "dear." After 9 concern regarding use of such terms was brought to Mr. Marek’s attention, he stopped 10 all such use. 11 4. On at least one occasion during the 2001-2002 school year at Glide High 12 School, Mr. Marek touched one or more female students’ arms or shoulders offering 13 them encouragement on their art projects. After concern regarding such contact was 14 brought to Mr. Marek’s attention, he stopped such contact. 15 5. On at least one occasion during the 2004-2005 school year at Central High 16 School, Mr. Marek complimented female students when they wore skirts to school on 17 game days. 18 6. On at least one occasion during the 2004-2005 school year at Central High 19 School, Mr. Marek, touched a female student on the shoulder to express concern 20 regarding the terminal illness 0f a mutual friend. 21 7. During the 2004-2005 school year at Central High School, Mr. Marek invited 22 female students to go running with him after practice after the District advised Mr. Marek 23 not to do so. 24 / // 25 /// Page 2 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - MAREK 1 8. Mr. Marek accepted responsibility for the foregoing behavior, and will 2 voluntarily engage in teacher-student boundaries training through a provider acceptable 3 to the Commission. Mr. Marek’s failure to maintain professional student-teacher boundaries 16 violates OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(1)(c). The 17 Commission's authority to impose discipline in this matter is based upon ORS 342.175. 18 ORDER 19 The Commission adopts the above findings of fact and hereby imposes thirty (30) day 20 suspension on Dean Marek. 21 lT IS SO ORDERED this iday of November, 2007. 22 TEACHER STANDARDS AND PRACTICES COMMISSION 23 .
