l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF TI-[E STATE OF OREGON 3 In the Matter of the Teaching License of 4 I STIPULATION OF FACTS AND ORDER OF KIM MENGEL WORRAL PROBATION 5 _—~\ 6 7 On or about Mar-eh 16, 2001, the Teacher Standards and Practices Commission 8 (Commission) issued a Notice of Opportunity for Hearing to Kim Mengel Worrall in which the 9 Commission proposed to take disciplinary actions against Worrall under ORS 342.175 through 10 ORS 432.190. The Commission and Mr. Worrall have now reviewed the matters alleged and ll agree that their respective interests, together with the public interest, are best served by 12 stipulation to certain facts and the imposition of a period of probation of one (l) year. This 13 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. In 14 entering into this stipulation, Mr. Worrall waives the right to a hearing to contest the findings of 15 fact, conclusion of law and order set forth below. Mr. Worrall understands that the probation l6 will be subject to specific conditions. l7 STIPULATION 0F FACTS l8 l. The Commission has licensed Mr. Worrall as an Oregon Educator continuously l9 since February 8, 1974. Currently, Mr, Worrall holds a Basic Oregon Teaching License with 20 Basic Reading and Basic Spanish Endorsements valid until January 9, 2002. Mr. Worrall was employed by Portland Public School as an Elementary Teacher 2 from 1977 until June of 1999 when he resigned to move to the family farm near Rainier, Oregon. 3 There were no complaints in his personnel file with Portland Public Schools. 4 3. Mr. Worrall was employed by the Rainier School District at Rainier Intermediate 5 School for the 1999-2000 school year. During the fall of 1999, there were two incidents in 6 which Mr. Worrall failed to demonstrate skill in classroom management and or skill in 7 communicating with students by exhibiting angry behavior; those incidents involved slamming a 8 book down on a desk and yelling at a busload of students about their behavior. 9 4. Mr. Worrall is employed in a temporary teaching position in the Clatskanie 10 School District. ll 5. Mr. Worrall accepts responsibility for his behavior and acknowledges his . 12 behavior was inappropriate during both incidents at Rainier Intermediate School during the fall l3 of 1999. l4 This stipulation is contingent upon approval and adoption of the Order by the 15 Commission.
