g’ 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION 5 WILLIAM DOUGLAS REINHART ) AND PROBATION 673 ) 8 On or about February 20, 2001, the Teacher Standards and Practices 9 Commission (Commission) received a report from Kerm Bennett, Superintendent, 1O Grants Pass School District, alleging that William Douglas Reinhart violated the 11 Districts Acceptable Use Agreement for electronic communication. 12 On or about May 3, 2001, the Commission notified William Douglas Reinhart of 13 that report, provided him a copy of that report and invited his response. 14 Mr. Reinhart fully cooperated with the Commission's investigation. After review 15 of the matters alleged, Mr. Reinhart and the Commission agree that their respective 16 interests, together with the public interest, are best served by a stipulation to certain 17 facts and the imposition of a thirty (30) day suspension, followed by a period of 18 probation of one (1) years. 19 This Order sets forth the facts upon which the parties have agreed and the 2O sanction to be imposed. In entering into this stipulation, Mr. Reinhart waives the right to 21 a hearing to contest the finding of fact, conclusion of law and order set forth below. Mr. 22 Reinhart understands that the probation will be subject to specific conditions. 23 This stipulation is contingent upon approval and adoption of the Order by the 24 Commission. If the Commission does not adopt this Order, neither Mr. Reinhart nor the 25 Commission are bound by these Stipulations and Mr. Reinhart retains all rights to a 26 hearing on the allegations. Mr. Reinhart holds a Standard Administrative License with a Standard 3 Administrator Endorsement valid January 7, 2000 through February 6, 2005. The 4 Commission has continually Licensed Mr. Reinhart since 1975. There are no prior y 5 complaints on file. 6 2. Mr. Reinhart is employed by the Grants Pass School District as Principal of 7 Redwood Elementary School. 8 3. A District-owned computer with Internet access and email is present in Mr. 9 Reinharts office for his use in connection with his assigned responsibilities. 10 4. The District has a clearly defined, acceptable use policy that has been in force 11 since May 5, 1998. The Acceptable Use Regulation specifically states that use of the ' 12 system for inappropriate or obscene purposes are prohibited. 13 5. Mr. Reinhart used his office computer on at least two occasions to send or 14 receive sexually suggestive or inappropriate email through the Districts server in 15 violation of District policy. Mr. Reinhart printed this material referred to as “jokes” from 16 his email and distributed these to staff during student contact hours on at least two 17 occasions. 18 6. Mr. Reinhart admits that he should not have used the District computer for 19 receiving or transmitting inappropriate materials or printing these materials for 20 distribution to staff and has expressed remorse for doing so. 21 ULTIMATE FINDING OF FACT 22 William Reinhart used the computer equipment owned by his employer, Grants . 23 Pass School District, located on school premises, to access sexually suggestive 24 materials and distribute these materials to staff. At the end of this suspension period, Mr. Reinharts Standard Administrative 2O License will be reinstated upon submission of a complete application and fees. 1 21 Upon the reinstatement of his teaching license, Mr. Reinhart shall be placed on . 22 probation by the Commission for a period of one (1) year subject to the following 23 conditions: , 24 1. Submission of documentation that he has completed (at his own expense), an 25 intensive education program regarding appropriate professional boundaries conducted .26 by a qualified trainer approved in advance by the Commission. This intensive training 27 shall consist of, at least, five (5) one and one-half (1 1/=) hour sessions.
