‘ 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the Teaching License of 4 STIPULATION AND SURRENDER OF 5 DENNIS PALANUK I LICENSE 6 On May l7, 2000, the Teacher Standards and Practices Commission (Commission) 7 issued a Notice of Opportunity for Hearing to Mr. Dennis Palanuk. Thereafter, Mr. Palanuk 8 requested a hearing through his attorney Mr. John S. Bishop. The Commission and Mr. Palanuk 9 have now reviewed the issues connected with this proceeding and have determined that their 10 respective interest and the public interest are best served by a stipulation to certain facts, and a 11 surrender of Mr. Palanuk’s teaching license. Mr. Palanuk understands that in entering this % 12 stipulation he is waiving his right to a hearing. This agreement sets forth the facts upon which 13 Mr. Palanuk and the Commission have agreed and the Commission’s order accepting Mr. 14 Palanuk’s surrender of his teaching license and revoking the license. 15 STIPULATION OF FACTS 16 Mr. Palanuk and the Commission stipulate as follows: l7 1. Mr. Palanuk holds a basic personnel license which is expired and a standard 18 teaching license. From 1981 through 1999, he taught mathematics at Eagle Point Junior High 19 School. He is currently teaching at the college level. 20 2. On or about May 27, 1999, Mr. Palanuk placed his hands around the neck of 21 EMD, a student who was talking in class, choked him and said, “I’1l kill you.” 22 3. Myton Date 8 Executive Director 9 CONCLUSIONS OF LAW 10 Mr. Palanuk’s actions towards the first student constituted gross neglect of duty by 11 unreasonable physical force in violation of OAR 584-020-0040(d).
