1 BEFORE THE TEACHERS AND STANDARDS AND PRACTICES COMMISSION . ‘ 2 OF THE STATE OF OREGON 3 . 4 In the Matter of the ] STIPULATION OF FACTS 5 Teaching License of ) AND ORDER OF PUBLIC REPRIMAND 6 ADAM KRONBERGER ) AND PROBATION 7 ) 8 9 On August 20, 1999, the Teacher Standards and Practices Commission informed Adam 10 Kronberger that the Commission found sufficient evidence of violation of Standards for 11 Competent and Ethical Performance of Oregon Educators to warrant a hearing regarding Mr. 12 Kronberger's January 1999 conviction for Misdemeanor Theft. Before a hearing date was set, 13 the parties have agreed that their respective interest and the interests of the State are best 1 14 served by a Stipulation of Facts and Order of Public Reprimand and Probation as set forth 15 below. 16 17 STIPULATION OF FACTS l8 19 1. Adam Kronberger (DOB 04-09-76) graduated from Oregon State University in June 20 1998 with a major in mathematics and a minor in history. 21 22 2. Kronberger enrolled in the Master of Arts in Teaching Program at Oregon State 23 University during the 1998-99 school year. 24 25 3. On September 1, 1998, Kronberger completed the PA-l Form for fingerprinting and 26 registration for student teaching and practice. and answered "no" to the eleven character 27 questions on that form. Thus, Kronberger was aware that any conviction for felony, . i 28 misdemeanor or major traffic violaiton would be considered upon application for 29 licensure. Kronberger's fingerprints cleared FBI on November 27, 1998. 30 3 1 32 4. On January 15, 1999 Kronberger was issued a summons and complaint for 33 misdemeanor for theft of a leather jacket, skirt, shirt, and dress valued at $100.96 from 34 Mervyns retail store in Albany, Oregon. 35 36 5. On January 27, 1999 Kronberger pled "guilty" to the charge and was sentenced to two 37 years probation and required to complete 50 hours of community service within six 38 months. 39 40 6. Kronberger did not report this incident to Oregon State University where he was 41 enrolled in professional internship in science / math education. 42 43 7. Kronberger answered "yes" to character questions 8 and 10 on his application for 44 licensure Form C-l, dated July 12, 1999. He provided a written explanation and court 45 record. 46 47 8. Kronberger did not disclose the conviction on his application for employment with 48 Hillsboro School District. On August 18, 1999, Hillsboro School District requested 49 issuance of the Initial License to Kronberger with expedited service, but the file was 50 referred to the Executive Director because of the recent conviction, hence the 51 application was held pending signatures on this Stipulation of Facts. 52 53 9. Kronberger has met all conditions imposed by the court in January 1999 and has a . i . 54 clear record as a student at Oregon State University from fall 1994 through summer 55 1999. PAGE 1-PROPOSED STIPULATION AND ORDER—ADAM KRONBERGER l Adam Kronberger enters into this Stipulation of Facts with knowledge that the Teacher . 2 Standards and Practices Commission will issue a Public Reprimand and place him on 3 Probation for a period of two years from the date the Commission adopts the Order. During the 4 probation, Kronberger will be required to complete a course or workshop approved by the 5 Commission on theft and will be required to comply with Standards of Competent and Ethical 6 Performance for Oregon Educators . This Stipulation is contingent upon approval and 7 adoption of the Order by the Commission. Myton, Executive Director Date 22 Teacher Standards and Practices Commission - 23 24 ULTIMATE FINDINGS OF FACT 25 26 Adam Kronberger was convicted in January 1999 on Misdemeanor charge of Theft. I-Ie failed to 27 disclose this fact to Oregon State University prior to recommendation for licensure and . 28 Hillsboro School District prior to offer of employment. 29 30 CONCLUSIONS OF LAW 3 l 32 Under ORS 342.175 and OAR 584, Division 020, educators are required to be law-abiding 33 citizen and to exemplify personal integrity and honesty. 34 35 ORDER 36 37 The Commission confirms the issuance of a teaching license to Adam Kronberger for 38 employment in Hillsboro School District. The Commission issues a Public Reprimand to 39 Kronberger and this Order shall serve as the reprimand. Mr. Kronberger shall be on Probation 40 from September 17, 1999 through September l7, 2001. During this period of probation Mr. 41 Kronberger shall complete, at his expense, a course or workshop approved by the Commission 42 on theft and shall conduct himself as a law-abiding citizen.
