l 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 431 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) REVOCATION OF 6 CHAD BRUCE PFEIFFER ) RIGHT TO APPLY FOR LICENSURE 7 8 On December 21, 2007, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Chad Bruce Pfeiffer (Pfeiffer) in which the Commission 10 charged him with misconduct under ORS 342.175. The Notice was sent via U.S. First Class Mail and 11 U.S. Certified Mail Receipt 7006 0810 0001 4602 2210 to the address Mr. Pfeiffer provided to the 12 Commission. The U.S. First Class Mail was signed by Mr. Pfeiffer and returned to the Commission on 13 December 31, 2007. The Notice of Opportunity of Hearing, dated December 21, 2007, and signed by l4 Victoria Chamberlain, Executive Director, stated: 15 "You, Chad Bruce Pfeiffer, are entitled to a hearing on the proposed action of the 16 Commission. If you want a hearing, you must file a written request for a hearing with 17 the Commission within 21 days of the date of this notice. Attached to this notice is a 18 copy of the procedures, right of representation and other rights of parties relating to the 19 conduct of a hearing as required under ORS 183.413(2).” 3(1) Mr. Pfeiffer did not request a hearing. The Commission, therefore, finds 22 Mr. Pfeiffer to be in default and enters the following findings of fact, conclusions of law and 23 order, based on the files and records of the Commission concerning this matter. 24 FINDINGS 0F FACT 25 1. The Commission first licensed Mr. Pfeiffer on May 5, 1998. On August 24, 2004, the 26 Commission issued Mr. Pfeiffer a Basic Teaching License with a Basic Elementary Endorsement. 27 Said license expired on June 13, 2007. 28 2. While working in the Milton-Freewater School District, Mr. Pfeiffer spent a substantial 29 amount of time accessing non-educational internet sites. This misconduct constitutes gross neglect of 30 duty in violation of OAR 584-020-0040(4)(b). Knowing and substantial unauthorized use of 31 employment time or school resources for private purposes. While working in the Milton-Freewater School District Mr. Pfeiffer failed to maintain an 2 appropriate student-teacher relationship by demonstrating or expressing a professionally 3 inappropriate interest in a students personal life by inviting students to spend the night at his house 4 without their parents’ knowledge, by allowing students to spend the night at his house as “friends”, 5 and by allowing a student to live with him for a month without obtaining permission from the students 6 parent. This misconduct constitutes gross neglect in violation of OAR 584-020-0040(4)(0) as it 7 incorporates 584-020-0035(1)(c)(A). Substantial deviation from professional ethics: Not 8 demonstrating or expressing professionally inappropriate interest in a student's personal life. 9 4. While working in the Milton-Freewater School District Mr. Pfeiffer failed to maintain an 10 appropriate student-teacher relationship by inviting male students to spend the night at his house 11 without their parents’ knowledge. This misconduct constitutes gross neglect in violation of OAR 584- 12 O20-OO40(4)(0) as it incorporates OAR 584-020-0035(1)(c). Substantial deviation from professional 13 ethics: Maintain an appropriate professional student-teacher relationship. 14 5. While working in the Milton-Freewater School District Mr. Pfeiffer allowed male students to 15 spend the night at his house as your “friends”. This misconduct constitutes gross neglect in violation 16 of OAR 584-020-0040(4)(0) as it incorporates OAR 584-020-0035(c)(A). Substantial deviation from 17 professional ethics: Not demonstrating or expressing professionally inappropriate interest in a 18 student's personal life. l9 CONCLUSIONS OF LAW 20 Mr. Pfeiffer’s knowing and substantial unauthorized use of employment time or school 21 resources for private purposes constitutes gross neglect of duty in violation of OAR 584-020- 22 0040(4)(b). Mr. Pfeiffer’s substantial deviation from professional ethics: Not demonstrating or 23 expressing professionally inappropriate interest in a student’s personal life constitutes gross neglect of 1 24 duty in violation of OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(1)(c).
