6 On September 5, 2002, the Teacher Standards and Practices Commission (Commission)

7 received a report from Michael A. Funderburg, Superintendent, Vernonia School District indicating

8 that former Superintendent, Lawrence Gordon McClellan (McClellan) assigned several educators in

9 violation of licensure.
10 After review of the matters alleged, Mr. McClellan and the Commission agree that their
11 respective interests, together with the public interest, are best served by a stipulation to certain facts,
12 a one year suspension of his right to apply for licensure.
13 This Order sets forth the facts upon which the parties have agreed and the sanction to be
14 imposed. Mr. McClellan accepts the Commission's representation that there are sufficient facts in the
. Commission’s file and records to support the findings of fact and conclusions of law contained in this
16 order. In entering into this stipulation, Mr. McClellan waives the right to a hearing to contest the
17 findings of fact, conclusion of law and order set forth below. Mr. McClellan enters into this agreement
18 with the knowledge that the Commission will suspend his right to apply for Iicensure for one year. Mr.
19 McClellan and the Commission stipulate that the following facts are true:

21 1. The Commission licensed Mr. McClellan from July 1, 1972, until Mr. McClellan‘s Standard
22 Administrative License expired on April 4, 2004.
23 2. Mr. McClellan began his employment as Superintendent of Vernonia School District on July
24 1, 1997.
25 3. During the 1998-1999, 1999-2000, 2000-2001 academic years Mr. McClellan assigned his
26 wife, Jane McClellan, without proper Iicensure to serve as Vice Principal at Vernonia High School.
. Commission records indicate that Jane McClellan held a Standard Personnel Service License with a
28 Standard Counselor Endorsement during the assigned academic years.

1 4. During the 1997-1998 academic year Mr. McClellan assigned Jill Griffin to the position of
. School Counselor at Vernonia High School without proper licensure after the Commission denied a
3 second school year request for Misassignment. Mr. McClellan continued to assign Jill Griffin as a
4 school counselor for the 1998-1999, 1999-2000, 2000-2001, and 2001-2002 academic years.
5 5. During the 2000-2001 and 2001-2002 academic years Mr. McClellan assigned Christopher
6 McNeil to teach Life Science at Washington Elementary without proper licensure.
7 This Stipulation is contingent upon approval and adoption of the Order by the full Commission.
8 If the Commission does not adopt this Order, neither Mr. McClellan nor the Commission are bound by
9 these stipulations and Mr. McClellan retains the right to a hearing on the allegations.

D CONCLUSION OF LAW
17 While sewing as Superintendent of Vernonia School District Lawrence Gordon McClellan
18 assigned three separate educators in violation of licensure. This misconduct constitutes Gross
19 Neglect of Duty in violation of OAR 584-020-0040(4)(i) and OAR 584-050-0030(2). The
20 Commission's authority to impose discipline in this matter is based upon ORS 342.175.

1 ORDER
. The Commission hereby imposes a one-year suspension on Mr. McClellan’ right to apply for
3 licensure effective July 30, 2004. At the end of the suspension period Mr. McClellan may apply for
4 reinstatement of licensure by submitting a complete application and fees pursuant to OAR 584-050-
5 0015(3).
