1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 SHELLEY ANN MARTIN ) LICENSE REVOCATION 7 8 On December 5, 2003, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Shelley Ann Martin (Martin) in which the 10 Commission charged her with misconduct under ORS 342.175. The Notice was sent via U.S. 11 First Class Mail and U.S. Certified Mail Receipt 7002 2410 0001 9754 7504 to the address 12 obtained by the Commission and verified as her current residence. The Certified Mail receipt 13 was not returned to the Commission. The First Class Mail was not returned and is assumed 14 delivered. The Notice of Opportunity of Hearing, dated December 5, 2003, and signed by 15 Victoria Chamberlain, Executive Director, stated: "You, Shelley Ann Martin, are entitled to a hearing on the proposed action of the / Commission. If you want a hearing, you must file a written request for a hearing 18 with the Commission within 21 days of the date of this notice. Attached to this 19 notice is a copy of the procedures, right of representation and other rights of 20 parties relating to the conduct of a hearing as required under ORS 183.413(2).” 21 22 Ms. Martin did not request a hearing. The Commission, therefore, finds 23 Ms. Martin to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Ms. Martin holds a Standard Teaching License with an endorsement in Standard 27 Advanced Mathematics, issued May 13, 2003, valid until October 6, 2008. 28 2. On May 9, 2003, the Commission adopted a Stipulation of Facts, Order of 29 Reprimand and Probation in the matter of the teaching license of Shelly Ann Martin. In addition 30 to standard terms and conditions the Probation specifically requires that Ms. Martin conduct PAGE 1 - DEFAULT ORDER OF LICENSE REVOCATION - MARTIN .1 herself as a law-abiding citizen and beginning November 9, 2003, submit biannual reports to the 2 Commission of her compliance with her treatment plan. 3 3. On July 15, 2003, Ms. Martin was convicted of Theft II in the Circuit Court of the 4 State of Oregon for Washington County. 5 4. On November 9, 2003, Ms. Martin failed to provide evidence to the Commission of 6 compliance with the treatment plan. 7 CONCLUSIONS OF LAW 8 Ms. Martin's criminal conviction for Theft ll and her failure to provide evidence of 9 compliance with the treatment plan constitute Gross Neglect of Duty in violation of OAR 584- 10 020-0040(4)(k).
