1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION '2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REPRIMAND 5 SHELLEY ANN MARTIN ) AND PROBATION 6 On or about November 20, 2002, the Teacher Standards and Practices 7 Commission (Commission) received an application for renewal of a Standard Teaching 8 License from Shelley Ann Martin (Martin). Ms. Martin reported a criminal conviction on 9 the character question section of Application for Educator License Form C-1. 10 Ms. Martin fully cooperated with the Commission's investigation. After review of 11 the facts in this matter, Ms. Martin and the Commission agree that their respective 12 interests, together with the public interest, are best served by a stipulation to certain facts, the imposition of a Public Reprimand followed by a four (4) year probation. This ‘i Order sets forth the facts upon which the parties have agreed and the sanction to be 15 imposed. Ms. Martin stipulates that there are sufficient facts contained in the 16 Commission's files and records to support the findings of fact and conclusions of law set 17 forth below. In entering into this stipulation, Ms. Martin waives the right to a hearing to 18 contest the findings of fact, conclusion of law and order set forth below. Ms. Martin 19 understands that the probation will be subject to specific conditions. 2O Shelley Ann Martin enters into this Stipulation of Facts with the knowledge that 21 the Commission shall place her on probation for a period of four (4) years. This 22 Stipulation is contingent upon approval and adoption of the Order by the fuII 23 Commission. If the Commission does not adopt this Order, neither Ms. Martin nor the O Page 1 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - MARTIN 1 Commission are bound by these stipulations and Ms. Martin retains the right to a '2 hearing on the allegations. 3 STIPULATION OF FACTS' 4 1. Ms. Martin's Standard Teaching License expired on October 6, 2002. On 5 November 20, 2002, the Commission received a complete application for renewal of a 6 Standard Teaching License from Ms. Martin. 7 2. Ms. Martin is currently employed as a .5 FTE Math Teacher at Glenco High 8 School, Hillsboro School District. 9 3. On December 13, 2000, Ms. Martin was convicted of Child Neglect ll in Circuit 10 Court of the State of Oregon for Washington County. The police report indicates that 11 Ms. Martin left her five-year old son locked in a vehicle outside a bar for one hour while she was inside consuming alcohol at 11:30 p.m., on April 28, 2000. Ms. Martin pled i guilty to one charge of Child Neglect ll. The Court suspended imposition of sentence 14 and placed Ms. Martin on formal probation for two years requiring 40 hours community 15 service and alcohol evaluation and treatment. 16 4. Ms. Martin successfully completed an inpatient alcohol treatment program at 17 Parkview Chemical Dependency in Parkview, Colorado on March 2, 2001 . 18 5. On June 19, 2001, Ms. Martin was convicted for Probation Violation in 19 Washington County Circuit Court for leaving the State without written permission from 20 her Probation Officer. On February 15, 2002, Ms. Martin was convicted for Probation 21 Violation in Washington County Circuit Court for failure to submit documentation that 22 she had completed the community service hours as sentenced. This misconduct constitutes Gross Unfitness. The Commission's authority to 13 impose discipline in this matter is based upon ORS 342.175. '- /// 15 /// 16 /// Q Page 3 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - MARTIN 1 ORDER ' Q The Commission authorizes the renewal of a Standard Teaching License and 3 imposes a Public Reprimand on Ms. Martin. This Stipulation of Facts, Order and 4 Probation constitutes the Reprimand. Furthermore, the Commission imposes a four (4) 5 year probation upon Ms. Martin subject to the following terms and conditions: 6 1. Ms. Martin shall conduct herself as a law-abiding citizen; 7 2. Ms. Martin shall report in writing within ten days to the Executive Director of 8 the Commission any arrest or citation for any felony, misdemeanor, or major traffic 9 violation; 10 3. Ms. Martin shall, at her own initiative and expense, continue to obtain ' 11 treatment for her alcohol dependency as recommended by her alcohol treatment 2 provider and abstain from the consumption of alcohol. Q 4. During the period of her probation, Ms. Martin shall submit to the Executive 14 Director of the Commission reports of her compliance with the treatment plan. 15 Ms. Martin shall provide these reports to the Commission every six (6) months during 16 this probation, on or before: November 9, 2003, May 9, 2004, November 9, 2004, May 17 9, 2005, November 9, 2005, May 9, 2006, November 9, 2006, and May 9, 2007. 18 5. Ms. Martin shall comply with all Standards for Competent and Ethical 19 Performance under Oregon Administrative Rules Chapter 584, Division 020. 20 If Ms. Martin does not comply with his treatment plan based on the reports of 21 her treatment provider or as othenlvise determined by the Executive Director she shall 22 be in violation of the terms of this probation.
