1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION g OF THE STATE OF OREGON g In the Matter of the Teaching License of ) 6 ) STIPULATION OF FACTS, 7 MAUREEN MARGARET MILLS ) ORDER OF REPRIMAND g ) AND SUSPENSION . 1O On or about July 6, 2001, the Teacher Standards and Practices Commission 11 (Commission) received an application for an Initial Teaching License from Maureen 12 Margaret Mills (Mills). 13 Ms. Mills responded “no” to character question , “8. Have you ever been 14 convicted or been granted conditional discharge by any court for: (a) any felony; (b) 15 misdemeanor; or (c) any major traffic violation..., “ Ms. Mills also responded “no” to 16 character question, “10. Have you ever entered a plea of guilty or No Contest relative to 17 any charge for an offense listed in question 8.?" TSPC records indicate she responded 18 “yes” to the same questions on a Form PA-1 Mills signed and submitted on or about 19 February 21, 2000. Together with the Form PA-t, Ms. Mills submitted a copy of a letter 20 from an attorney indicating that in 1995 she was charged with, minor in possession, 21 assault 4m degree, public nuisance, furnishing liquor to minors and resisting arrest in 22 Asotin County, Washington. 23 After review of the facts in this matter, Ms. Mills and the Executive Director agree 24 that their respective interests, together with the public interests, are best served by a 25 stipulation to certain facts, Order of Reprimand and suspension of her right to apply for 26 licensure. 27 This Order sets forth the facts upon which the parties have agreed and the 28 sanction to be imposed. ln entering into this stipulation, Ms. Mills waives the right to a Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND SUSPENSION - MILLS 1 hearing to contest the findings of fact, conclusion of law and order set forth below. Ms. . 2 Mills understands that the Commission will suspend her right to apply for a teaching 3 license for sixty (60) days. 4 This stipulation is contingent upon approval and adoption of the Order by the 5 Commission. lfthe Commission does not adopt this Order, neither Ms. Mills nor the 6 Commission are bound by these Stipulations and Ms. Mills retains all rights to a hearing 7 on the allegations. 8 STIPULATION OF FACTS 9 1. On or about September 27, 1995, Ms. Mills was convicted of Minor in Possession, 10 Furnishing Liquor to Minors and Noise Ordinance (misdemeanor crimes) in District 11 Court for Asotin County Washington. The Court sentenced Ms. Mills to serve 90 12 days in jail, “all but 48 hours" suspended; placed her on 13 months probation; and ‘1 3 fined her $600.00. 14 2. On or about July 3, 2001, Ms. Mills signed and submitted an application for an Initial 15 Teaching License to TSPC. She responded “no” to all character questions. 16 3. On August 8, 2001, Ms. Mills told the TSPC Investigator that her misdemeanor 17 convictions in Washington State had been expunged from her criminal record prior 18 t0 completing her July 3, 2001, application for an Initial Teaching License. i 19 4. On August 28, 2001, Ms. Mills provided TSPC with a copy of an Order granting on 1 20 Motion re: Vacating Conviction for Minor in Possession, Furnishing Liquor to Minors ‘ 21 and Noise Ordinance entered in Municipal Court of Clarkston, Washington, County j 22 of Asotin on August 28, 2001. l 23 5. Myton, Exe tive Director Date 7 CONCLUSION OF LAW 8 As per OAR 584-050-0006 the Executive Director may deny issuance of 9 licensure when the applicant submits a falsified application or when the applicant has 1O been convicted of any felony, a misdemeanor or major traffic violation. MS. Mills 11 September 27, 1995, convictions for misdemeanor crimes in Washington State are 12 grounds for denial of licensure. Ms. Mills submission of a falsified application on or 13 about July 3, 2001, is grounds for denial of licensure. 14 ORDER .15 The Commission adopts the above Stipulation of Facts, Conclusion of Law, 16 imposes a Reprimand and suspends the right of Maureen Margaret Mills to apply for an 17 Oregon Teaching License effective September 14, 2001, for a period of sixty (60) days. 18 This Stipulation of Facts and Order constitutes the Reprimand. 19 Dated this 14”“ day of September 2001. 2O TEACHER STANDARDS AND PRACTICES COMMISSION 21 I 22 By: . 23 David V.
