6 On May 18; 2000, the Teacher Standards and Practices Commission (Commission)
7 issued a Notice of Opportunity for Hearing to Robert George Kaltwasser. Thereaiter Mr.
8 Kaltwasser requested a hearing through his attorney Mr. Thomas Doyle The Commission and
9 M1‘ Knltwasser have now reviewed the issues connected with this proceeding and have
10 determined that their respective interests and the public interests are best sewed by a stipulation
.l to certain facts and a public reprimand oeri Kaltwasser followed by a period of probation. Mr.
12 Kaltwasser understands that in entering this stipulation he is waiving his right to a hearing and
l3 the Commission will publicly reprimand him and put him on probation. He fiirther understands
l4 that the probation will be subject to specific conditions.
15 STLPULATED FACTS
16 Mr. Kaltwasser and the Commission stipulate as follows:
l7 1. Mr. Keltwasser holds a standard teaching license with endorsements in standard
18 biology and standard integrated science. MI. Kaltwasser has taught with the Newberg School
l9 District from 1981 to the present at both Renne and Mountain View Middle School He is still
20 employed by the district.

2 to support a finding of fact that on m’ about April 28, 1999, Mr. Ksltwasser used a notebook to

4 Kaltwasser has no independent recollection ofniis event.
5 3. During 1998-99 academic year, Mr. Kzltwasser admitted he told inappropriate

19 The Commission imposes a public rqirimnd on Mr. Kaitwasser. This order constitutes
20 the reprimand. Furthermore, the Commission imposes a two-year probation upon
. 21 Mr. Keltwmer subject to the lbllowing conditions;

l l. Mr. Kaltwasser shall, at his own expense, participate in an intensive three-hour
2 education program for sexual harassment with a qualified trainer of the Commission’s choosing.
3 The Commission will provide the trainer with The Notice of Opportunity for Hearing and the
4 Report of Preliminary Investigation and this Stipulation and Order prior to Mr. Kaltwasscr’s
5 beginning the program. The program trainer will provide the Commission with a report of
6 successful program completion.
7 2. Mr. Kaltwasscr shall comply with all TSPC standards under OAR 584, Division 20.
8 3. Mr. Kaltwnsser shall provided to the Commission such information as the i
9 Commission requests to verify that he has complied with the conditions of probation, including a
10 statement from his employing school district, if any, that he has complied with the standards of
.l competent and ethical performance of educators under OAR 584, Division 20.
12 Violations of the terms of this probation may constitute an independent basis for the
13 Commission to impose discipline, up to and including revocation of Mr. Kaltwasscr’s Oregon
l4 Teaching License, and subj oct to Mr. Kaltwasser’s right to a hearing on the issue of whether he
15 violated probation. fl
