STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) Basic Teaching License of ) STIPULATION OF FACTS, KATHRYN ANN SHERER ) PUBLIC REPRIMAND ) AND ORDER OF PROBATION On 0r about June 27, 2000, Portland Public Schools reported to the Teacher Standards and Practices Commission (Commission) that Kathryn Ann Sherer was convicted on October 22, 1999, for Theft I, a misdemeanor, for unlawfully obtaining unemployment benefits between August 24, 1997, and January 11, 1998, while employed as a coach for Portland Public Schools. After a review of the matters alleged, the parties have agreed that their respective interests, together with the public interest, are best served by a stipulation of certain facts and conclusions of law. This agreement sets out the facts upon which the parties have agreed and the sanctions to be imposed, and the basis for the Commission’s order. In entering into this Stipulation, Sherer waives her right to a hearing to contest any of the findings set forth below. STIPULATED FACTS Sherer agrees and stipulates that substantial evidence exists in the record to support the following findings of fact by the Commission: 1. On October 22, 1999, Sherer pled guilty and was convicted of the crime of Theft I, a misdemeanor, by the Circuit Court of Oregon, Multnomah County. 2. Sherer had unlawfully claimed unemployment benefits between August 24, 1997, and January l 1, 1998, while employed by Portland Public Schools as a coach. 3. On her application for reinstatement of licensure dated May 25, 2000, Kathryn Ann Sherer disclosed that she had pled guilty and had been convicted for Theft I. Sherer provided the court record as required by the Commission. 4. Sherer was placed on probation for 24 months ending October 2001, required to pay restitution of $3,337, assigned 160 hours of community service, required to , attend Theft Talk and to tour the Oregon State Penitentiary. 5. Sherer is employed by Portland Public Schools as a teacher of health and physical education for 2000-01. This Stipulation and the proposed order are contingent upon approval by the full ‘ Commission at the Commission’s next meeting If the Commission does not approve this Stipulation, the matter will be returned for a hearing, and neither Sherer nor the Commission shall be bound by any matters in this Stipulation. ( . \ P ‘i i ’ CONCLUSIONS OF LAW Kathryn Sherer’s conviction for Theft I and unlawfully obtaining public assistance constitute gross neglect of duty under ORS 342.175 and OAR 580-20-040. The parties acknowledge that upon execution of this Stipulation, the Commission will enter into an order reprimanding Sherer and placing Sherer on probation with the Commission for one year from the date of adoption of the order. The Commission imposes a public reprimand on Kathryn Sherer, and this Order shall serve as the public reprimand. 2. The Commission also places Sherer on probation. The probation shall commence on the date of adoption of this order and shall remain in effect for a period of one year thereafter subject to the following conditions: a. Sherer shall conduct herself as a law-abiding citizen. b. Sherer shall report in writing within ten days to the Executive Director of the Commission any arrest or citation for any felony, misdemeanor, or major traffic violation. c. Sherer shall comply with the Standards for Competent and Ethical Performance of Oregon Educators under OAR 584, Division 20.
