. 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ~ 2 OF THE STATE OF OREGON 3 In the Matter of the Teaching ) License of: ) STIPULATION OF FACTS, 4 ) PUBLIC REPRIMAND, AND 5 RAYMOND JOHN SUEK, SR. g ORDER OF PROBATION ____________________________________) 6 7 On or about May 20, 1998, the Teacher Standards and 8 Practices Commission (the "Commission") issued a Notice of 9 Opportunity for Hearing to Raymond John Suek, Sr ("Suek") in 10 which the Commission proposed to suspend or revoke his teaching 11 license or otherwise impose discipline under ORS 342.177. The 12 Commission and Suek have now reviewed the matters alleged and 13 agree that their respective interests, together with the public . 14 interest, are best served by a stipulation to certain facts, the Z15 issuance of a public reprimand and placement on probation for a 16 period of one (1) year. This agreement sets forth the facts upon 17 which the parties have agreed and the sanctions to be imposed. 18 In entering into this Stipulation, Suek waives his right to a 19 hearing to contest any of the findings set forth below. 20 FINDINGS OF FACT 21 Suek agrees and stipulates that evidence in the record 22 exists to support the following Findings of Fact by the 23 Commission: 24 1. During the 1996-97, 1997-98 school years, Suek was ‘ 2 employed as a teacher at Walker Middle School in the Salem-Keizer 3 School District (the "District"). 4 3. In September 1997, a staff member reported that Suek 5 and a co-worker were romantically involved. 6 4. The District conducted an investigation into these 7 allegations. When questioned, Suek admitted that during the 8 Spring and Fall of 1997, he and the co-worker had engaged in a 9 consensual romantic relationship during school time and on school 10 premises on several occasions. 11 5. On October 31, 1997, Suek resigned his teaching 12 position. l3 Suek enters into this Stipulation of Facts with the 14 knowledge that TSPC will adopt an Order requiring the issuance of ‘15 a public reprimand, placing Suek on one year of probation and 16 imposing additional conditions while on probation. This 17 Stipulation is contingent upon the approval and adoption of the 18 Order by the Commission. Myton, Exe utive Secretary Date 7 Teacher Standards and Practices Commission 8 CONCLUSIONS OF LAW 9 The conduct described in the paragraph 4 of the Findings of 10 Fact constitutes gross neglect of duty as that term is defined 11 under ORS 342.175(1) and OAR 584-20-040(4), as Suek engaged in 12 inappropriate conduct with a co-worker during instruction time on 13 school premises. l4 OPINION ‘15 In consideration of Suek’s long, unblemished employment 16 record, and the nature of the inappropriate conduct, the 17 Commission believes that the sanction of public reprimand and 18 probation is appropriate. l9 ORDER 20 The Commission issues a public reprimand against Suek. The 21 Findings of Fact, Conclusions of Law and Order herein shall serve 22 as the public reprimand. Suek shall comply with all Commission requirement, including ‘ 2 but not limited to, those articulated in OAR 584 chapter 20 — the 3 standards for competent and ethical performance by Oregon educators. 4 2. Suek will provide to the Commission such information as 5 requested to verify that he has complied with the conditions of 6 probation, including a statement from his employing district that 7 he has complied with the standards for competent and ethical 8 performance. 9 3.
