1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 7 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND ORDER 0F REVOCATION 5 KENNETH WAYNE JOHNSON ) OF RIGHT TO APPLY 6 On or about October 12, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from Randy Harvey, Director of Human Resources, Tigard- 8 Tualatin School District, indicating that Ken Johnson (Johnson) resigned his teaching position 9 while under investigation for neglect of duty. Johnson cooperated with the TSPC investigation ' 10 into this matter. 11 After review of the matters alleged, Mr. Johnson and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts and revocation of his right to apply for a teaching license for one year. 14 This Order sets forth the facts upon which the parties have stipulated and the sanction to 15 be imposed. Mr. Johnson stipulates that there are sufficient facts contained in the 16 Commission's files and records to support the findings of fact and conclusions of law set forth 17 below. in entering into this stipulation, Mr. Johnson waives the right to a hearing to contest the 18 finding of fact, conclusion of law and order set forth below. Mr. Johnson understands that the 19 Commission will revoke his right to apply for a teaching license for one year. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. lf the Commission does not adopt this Order, neither Mr. Johnson nor the 22 Commission are bound by these Stipulations and Mr. Johnson retains all rights to a hearing on 23 the allegations. 24 STIPULATION 0F FACTS 25 1. The Commission issued a Standard Teaching License endorsed in Standard Health 26 Education and Standard Physical Education to Mr. Johnson on August 27, 2001. Said license 27 expired on October 6, 2006. Johnson has no history of discipline with the Commission. Page 1 STIPULATION OF FACTS, ORDER OF SURENDER AND REVOCATION — JOHNSON 1 2. On or about October 12, 2005, the Tigard Tualatin School District notified the 2 Commission that a District investigation uncovered allegations of inappropriate conduct by Mr. 3 Johnson. 4 3. Mr. Johnson was alleged to have allowed students to come to his house, on one 5 occasion, to help him wash his car. Such socializing outside of school hours and off school 6 grounds is not allowed by school district policy. 7 4. Mr. Johnson retired from his position at Tigard High School prior to the conclusion of 8 the District's investigation. Mr. Johnson contested the allegations levied against him. 9 5. This conduct 19 constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(k).
