06/07/2007 THU s: 47 FAX 503 378 3758 TSPC EXC FAX morn/0M ' 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 in the Matter of the ) STIPULATION OF FACTS. 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 MlCHAEL COLLINS MCGREE ) AND PROBATION 6 0n May 7, 2007, the Teacher Standards and Practices Commission (Commission) 7 received a report from Jonathan Hill, Superintendent, Douglas County Educational Service 8 District indicating that Michael Collins McGree (McGree) was then currently under investigation 9 by the Department of Human Services. 10 Mr. McGree lully cooperated with the Commission's investigation in this matter. After 1 1 review of the matters alleged, Mr. McGree and the Commission agree that their respective 12 interests, together with the public interest, are best sewed by a stipulation to certain facts, the 13 imposition of a public reprimand followed by a two (2) year probation. 14 This document sets forth the facts upon which the parties have agreed and the ' 15 stipulated sanction to be imposed. Mr. McGree stipulates that there is sufficient evidence in the 16 Commission's files and records to support the findings of tact, conclusions ot law, and order set ‘ 17 forth below. 1 18 Ely signing below, Mr‘ McGree acknowledges, understands, stipulates, and agrees to the 19 following: (i) he has been fully advised of his rights to notice and a hearing to contest the I 20 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 21 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 22 Order of Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final 23 Order is a public document and disclosed to the public upon request by the Commission; 24 (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by 25 the Commission. if the Commission does not approve and adopt this Stipulation and Final 26 Order, then neither Mr. McGree nor the Commission are bound by the terms herein; (iv) he has 27 fully read this Stipulation and Final Order, and understands it completely; (v) he voluntarily, Q Page 1 - STIPULATION 0F FACTS, FlNAi. onoaa or REPRIMAND AND PROBATION - mosses 05/01/2001 Tau 5:41 is; 503me mos/004 ' 1 without any force or duress, enters into this Stipulation and Final Order and consents to 2 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or 3 representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he 4 has consulted with an attorney regarding this Stipulation and Final Order and has been fully 5 advised with regard to his rights thereto, or waives any and all rights to consult with an attorney 6 prior to entering into this Stipulation and Final Order and issuance and entry oi the Stipulated 7 Final Order below. Mr. McGree understands that the probation will be subject to specific terms 8 and conditions. l 9 STIPULATION 0F FACTS 10 1. The Commission has licensed Michael Collins McGree since August 1 t, 1986. Mr, 11 McGree currently holds a Standard Teaching License valid October 25, 2006, through October 12 24, 2011, with a Standard Speech Impaired endorsement. 13 2. Mr. McGree is currently employed by Douglas County Educational Service District as ' 14 a lull time teacher. 15 3.
