.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION /: OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER 6 RICHARD WAYNE PRUITT ) REVOKING RIGHT TO 7 ) APPLY FOR LICENSURE 8 9 On or about February 14, 2002, the Teacher Standards and Practices Commission 10 (Commission) received information indicating that Richard Wayne Pruitt (Pruitt) was arrested on 11 two charges of Sex Abuse I. The Executive Director took action to notify Pruitt of intent to 12 revoke his license, and to inform him of his opportunity for hearing. The notice was sent via 13 U.S. First Class Mail and U.S. Certified Mail Receipt 7001 0320 0005 0740 8650. The certified 14 mail receipt was signed and dated on August 21, 2002. The Notice of Opportunity of Hearing, 15 dated August 20, 2002, and signed by Victoria Chamberlain, Executive Director, stated: 16 "You, Richard Wayne Pruitt, are entitled to a hearing on the proposed action of 17 the Commission. If you want a hearing, you must file a written request for a 2 hearing with the Commission within 21 days of the date of this notice. Attached 19 t0 this notice is a copy of the procedures, right of representation and other rights 20 of parties relating to the conduct of a hearing as required under ORS 21 183.413(2)." 22 23 Mr. Pruitt did not request a hearing. The Commission, therefore, finds Mr. 24 Pruitt to be in default and enters the following findings of fact, conclusions of law and 25 order, based on the files and records of the Commission concerning this matter. 26 FINDINGS OF FACT 27 1. On January 14, 2000, the Commission adopted an Order of Suspension and 28 Probation to Richard Wayne Pruitt. Mr. Pruitt did not attempt to reinstate his suspended license. 29 2. On July 22, 2002, Richard Wayne Pruitt was convicted of two counts of Sexual 30 Abuse l, ORS 163.427, in the Circuit Court of the State of Oregon for the County of Yamhill. 31 The court sentenced Mr. Pruitt to serve 60 days in jail; placed him on probation for 240 months; 32 and ordered him to pay a monetary obligation of $1 ,21000. The convictions listed above were the result of Mr. Pruitt’s relationship with a 2 student attending Patton Middle School in the McMinnville School District in 1993 and 1994. 3 CONCLUSIONS OF LAW 4 The crime of Sex Abuse I, ORS 163.427, is listed in ORS 342.143(3).
