9 On June 15, 2007, the Teacher Standards and Practices Commission (Commission) issued a
10 Notice of Opportunity for Hearing to Pamela Sue Underwood (Underwood) in which the Commission
11 charged her with conviction of a crime listed in ORS 342.143(3). The Notice was sent via U.S. First
12 Class Mail and U.S. Certified Mail Receipt 7006 0810 0001 4602 1671 to the address Ms. Underwood
13 provided to the Commission. The U.S. First Class Mail was returned unclaimed to the Commission on
I4 June 12, 2007, and the U.S. Certified Mail returned on June 13, 2007. Another Notice was sent via
15 U.S. First Class Mail and U.S. Certified Mail Receipt 7006 0810 0001 4602 1763 to the address

16 obtained by the Commission. The U.S. First Class Mail and U.S. Certified Mail was returned

17 unclaimed to the Commission on June 18, 2007. The Notice of Opportunity of Hearing, dated

D June 15, 2007, and signed by Victoria Chamberlain, Executive Director, stated:
19 "You, Pamela Sue Underwood, are entitled to a hearing on the proposed action of the
20 Commission. If you want a hearing, you must file a written request for a hearing with
21 the Commission within 21 days of the date of this notice. Attached to this notice is a
22 copy of the procedures, right of representation and other rights of parties relating to the
23 conduct of a hearing as required under ORS 183.413(2).”

25 Ms. Underwood did not request a hearing. The Commission, therefore, finds
26 Ms. Underwood to be in default and enters the following findings of fact, conclusions of law
27 and order, based on the files and records of the Commission concerning this matter.
28 FINDINGS OF FACT
29 1. Ms. Underwood has been licensed by the Commission since September 13, 1990. The
30 Commission issued Ms. Underwood a Basic Teaching License on March 13, 2006, valid until
31 March 12, 2009, with a Basic Elementary Endorsement.
32 2. Ms. Undenlvood began employment as a Substitute for Salem-Keizer Public Schools in
p 1992.

1 3. On or about November 17, 2006, Ms. Underwood was convicted of three (3) counts of
. Criminal Mistreatment I, ORS 163.205 and three (3) counts of Endangering the Welfare of a Minor,
3 ORS 163.575, in the Circuit Court of the State of Oregon for Marion County.
4 CONCLUSIONS OF LAW
5 Ms. Underwood's conviction of Endangering the Welfare of a Minor, ORS 163.575 is listed in
6 ORS 342.143(3). The Commission is required to revoke the Basic Teaching License issued to
7 Ms. Underwood and revoke her right to apply for a license pursuant to ORS 342.175(2).
8 Ms. Underwood’s conviction for Criminal Mistreatment l, ORS 163.205 constitutes Gross
9 Unfitness as defined in OAR 584-020-0040(5)(c). The Commissions authority to impose discipline in
10 this matter is based upon ORS 342.175.
Il ORDER
12 The Commission hereby revokes the Basic Teaching License issued to Pamela Sue
13 Underwood and revokes her right to apply for a teaching license.
