ALLEN ) OF PROBATION v 1 8 9 On August 28, 1998, the Teacher Standards and Practices Commission 10 informed Jerry M. Allen that the Commission found sufficient evidence of 11 violation of Standards for Competent and Ethical Performance of Oregon l2 Educators to warrant a hearing regarding Allen’s 1996 conviction for Assault IV 13 and Harassment. Before a hearing date was set, the parties have agreed that 14 their respective interest and the interests of the State are best served by a 15 Stipulation of Facts and Order of Probation as set forth below. l6 17 STIPULATION OF FACTS 18 19 1. Jerry Allen completed the Portland State University teacher education 20 program in July 1998 and has been recommended for a Basic Teaching 21 License with Basic Elementary Endorsement. 22 23 2. Mr. Allen has been offered a teaching position in Portland Pulbic Schools 24 as a teacher of basic (elementary) mathematics skills in Jefferson High 25 School in accordance with OAR 584-036-0015[2). i / 26 27 3. Mr. Allen disclosed to Portland State University, Portland Public Schools, 28 and Teacher Standards and Practices Commission that he had been 29 convicted on December 20, 1996 for Assault IV (a misdemeanor) and 30 Harassment (a misdemeanor). A charge of Recklessly Endangering was 31 dismissed. Mr. Allen was fined, placed on probation for one year and 32 ordered to complete an anger management program. 33 34 4. On December l7, 1997, Mr. Allen was arrested for Failure to Appear in 35 the Second Degree and plead guilty to probation violations on the 1996 36 convictions for Assault IV and Harassment. His probation was extended 37 for one additional year to December 31, 1998. 38 39 5. Mr. Allen has conducted him selfin an appropriate manner in the 40 Portland Teacher Program and has favorable recommendations from 41 program faculty and cooperating school personnel. 42 PAGE l-PROPOSED STIPULATION AND ORDER—JERRY M. ALLEN . 1 Jerry M. Allen enters into this Stipulation of Facts with knowledge that the ' - 2 Teacher Standards and Practices Commission will place him on probation for 3 two years . This Stipulation is contingent upon approval and adoption of the 4 Order by the Commission. Allen was convicted in December 1996 on misdemeanor charges of 24 Assault in the Fourth Degree and Harassment and is on probation until ' 25 December 31, 1998. 26 27 CONCLUSIONS OF LAW 28 29 Under ORS 342.143 and OAR 584, Division 20 require educators to be law- 30 abiding citizens. 31 32 ORDER 33 34 The Commission confirms issuance of a Teaching License to Jerry M. Allen for 35 employment in Portland Public Schools. Mr. Allen shall be on probation from 36 September 10, 1998 to September 10, 2000.
