1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 5 In the Matter of the | 6 Teaching License of | DEFAULT ORDER OF 7 ALAN ATTILA HAKIMOGLU | DENIAL OF LICENSURE 8 | 9 l0 11 On July l8, 2001, the Teacher Standards and Practices Commission issued a Notice 12 of Opportunity for Hearing to Alan Hakimoglu, in which the Commission proposed to deny 13 the teaching license of Alan Hakimoglu under ORS 342.143. The notice was sent via U.S. 14 First Class Mail and U.S. Certified Mail Receipt #7000 0600 0023 8496 7941 at the address 15 Mr. Hakimoglu provided to the Commission. The certified mail receipt was signed and dated 16 by Alan Hakimoglu on July 28th and returned to the Commission, Alan Hakimoglu did not 17 request a hearing. 18 The Notice of Opportunity for Hearing, signed by David V. Myton, Executive 19 Director, stated: .20 If a request for hearing is not received within this 21-day period, your right to 21 hearing shall be considered waived unless your failure to request a hearing was 22 beyond your reasonable control. If you do no request a hearing or if you fail to 23 appear at a hearing, the Commission will adopt an Order of Default which may 24 include the revocation or suspension of your license or other discipline. 25 26 Based on the foregoing, the Commission finds Alan Hakimoglu in default and such ‘ 27 default is hereby entered. Based on the records and files of the Commission, the 28 Commission enters the following findings of fact and order. 29 30 FINDINGS OF FACT 3 l 32 l. On or about November l7, 2000, Alan Hakimoglu submitted an Application for 33 Educator License Form C-l. Hakimoglu answered “yes” to character questions 8 and lO. ‘ l 34 2. On December 29, 2000, the Executive Director recommended licensure with l 35 probation to run concurrent with Hakimoglu’s court imposed probation of October 27, 1 , 36 2000, to April 26, 2002. On February 6, 2001, the Executive Director informed Alan Hakimoglu of 4 additional documents the Commission required before it could determine Whether Mr. 5 Hakimoglu was fit to be granted a teaching license. These documents included copies of 6 police reports and court records conceming Mr. Hakimoglu’s convictions and 7 documentation of Mr. Hakimoglu’s successful completion of an alcohol/drug program. 8 The Commission further informed Mr. Hakimoglu that if these documents were not 9 received within thirty days, the Commission would take action to approve or deny his 10 application. 11 4. On March 7, 2001, Hakimoglu requested withdrawal, at least temporarily, of his 12 application for an Oregon teaching license. In order to acquire necessary documents, l3 Hakimoglu wanted to postpone consideration of his licensure until May 2001. 14 5. On April 30, 2001, Hakimoglu submitted documentation for several items 15 requested in the February 6'h correspondence from the Executive Director, but failed to 16 provide documentation of successful completion of an alcohol/drug program. Hakimoglu '17 stated he hoped to respond to this item soon. 18 6r As of July l8, 2001, Hakimoglu has not complied with the requirement to 19 submit documentation of successful completion of an alcohol/drug program together with a 20 copy of initial evaluation. 21 7. November 14, I997, Mr. Hakimoglu was convicted for driving under the 22 influence of intoxicants in Multnomah County District Court. 23 8. On October 27, 2000, Mr. Hakimoglu was convicted of Criminal Trespass II in 24 Multnomah County District Court based on his behavior at the Powell’s Book Store in 25 Portland. The court sentenced Mr. Hakimoglu to l8 months probation with conditions that 26 he stay away from Powell’s Book Store, participate in anger counseling, carry no weapons 27 and write a letter of apology to the victims of his crime. 28 29 CONCLUSIONS OF LAW 30 The above conduct constitutes gross unfitness under OAR 584-020-0050. Mr. 31 Hakimoglu has not established that he possesses good moral character, mental and physical ' 32 health, or other sufficient evidence of his fitness to serve as a teacher.
