OF THE STATE OF OREGON 431 In the Matter of the ) DEFAULT ORDER 5 Teaching License of ) REVOKING RIGHT TO APPLY 6 MICHAEL TERRAMIN ) FOR LICENSURE 7 8 On January 7, 2003, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Michael Terramin (Terramin) in which the 10 Commission charged him with conviction of a crime listed In ORS 342.143(3). The Notice was 11 sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7001 0320 0005 0740 5383 to the 12 address obtained by the Commission. The certified mail receipt was signed and dated by 13 Mr. Terramin on January 30, 2003, and returned to the Commission on January 31, 2003. The 14 Notice of Opportunity of Hearing, dated January 7, 2003, and signed by Victoria Chamberlain, 15 Executive Director, stated: 6 "You, Michael Terramin, are entitled to a hearing on the proposed action of the q Commission. If you want a hearing, you must file a written request for a hearing wrth the Commission within 21 days of the date of this notice. Attached to this 19 notice is a copy of the procedures, right of representation and other rights of 20 parties relating to the conduct of a hearing as required under ORS 183.413(2)." :2 Mr. Terramin did not request a hearing. The Commission, therefore, finds 23 Mr. Terramin to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS 0F FACT 26 1. On December 2, 1999, the Commission issued a Limited Student Services License 27 to Michael Terramin. The license expired on December 2, 2002. 28 2. On December 3, 1999, Yamhill Education Service District hired Michael Terramin as 29 a Social Service Specialist. He resigned effective June 15, 2002. 30 3. On January 3, 2003, Michael Terramin was convicted of Sexual Abuse II, ORS 31 163.425, in the Circuit Court for the State of Oregon for the County of Linn. .
