The notice was served on Mr. 11 Annala by mailing it through the U. S. Postal Service by U. S. First Class mail and U. S. 12 Certified Mail, return receipt requested, to Mr. Annala at 2172 E Bishop Drive, Tempe, AZ 13 95282-2954. The certified mailing was returned to the Commission as "unclaimed." The first 14 class mailing was not returned. Mr. Annala has not requested a hearing. 15 16 Based on the foregoing, the Commission finds Mr. Annala in default and such default is hereby 17 entered. Based on the records and files of the Commission, the Commission enters the 18 following finding of facts and order. l9 20 FINDINGS OF FACT 21 22 1. David Annala held a Standard Administrative License with Administrator endorsement, 23 which expired on October 24, 1997. 24 25 2. Annala was employed as a Principal at McNary High School in the Salem-Keizer School 26 District from September 1992 to April 22, 1997. Mr. Annala was dismissed from his 27 position by the Salem-Keizer School Board effective April 22, 1997. . .28 ' /29 3. During the academic years of 1992-93, 1993-94, 1994-95, 1995-96 and 1996-97 David 30 Annala violated OAR 584-020-0040(4)(a] and (b) by knowing and substantial 31 unauthorized use of school materials or equipment, school personnel and employment 32 time for personal purposes. 33 34 4. During the academic years of 1992-93, 1993-94, 1994-95, 1995-96 and 1996-97 David 35 Annala violated OAR 584-020-0040(4)(1) by subjecting female staff to sexual 36 harassment. 37 38 5. During the academic years of 1992-93, 1993-94, 1994-95, 1995-96 and 1996-97 David 39 Annala violated OAR 584-020-0040(4)(n) by failing to demonstrate a commitment to 40 recognize the worth and dignity of all persons, failing to demonstrate a commitment to 41 use professional judgment, and failing to demonstrate skill in meeting the standards of 42 competency through human relations and communications. 43 44 4S ULTIMATE FINDINGS OF FACT 46 47 David Charles Annala failed to use professional judgment, recognize the worth and dignity of 48 all persons, and demonstrate skill in meeting the standards of competency through human 49 relations and communications. 50 51 CONCLUSIONS OF LAW 52 S3 Mr. Annala's conduct constitutes gross neglect of duty in violation of OAR 584-020-0040.
