BAUMANN STIPULATION AND ORDER 5 reacner otandarqs _ and Practices Commisslon 6 On March 17, 2000, the Teacher Standards and Practices Commission (Commission) 7 issued a Notice of Opportunity for Hearing to Robert G. Baumann in which the Commission 8 charged Mr. Baumann with misconduct and proposed to suspend, revoke or otherwise impose 9 discipline as provided under ORS 342.177. Mr. Baumann requested a hearing. 10 The Commission and Mr‘ Baumann have now reviewed the matters alleged and have ll agreed that their respective interests, together with the public interest, are best served by a 12 surrender of Mr. Baumann’s teaching license and a stipulation to certain facts. In entering this 13 stipulation, Mr. Baumann waives his right to a hearing. This agreement sets forth the facts upon l4 which Mr. Baumann and the Commission have agreed and the Commission’s order accepting 15 Mr. Baumann’s surrender of his teaching license and revoking the license. l6 STIPULATED FACTS 17 Mr. Baumann and the Commission stipulate as follows: l8 1. Mr. Baumann holds a Standard Teaching License with endorsements in Basic 19 Language Arts, Standard Handicap Learner and Basic Reading. 2O 2. Mr. Baumann was employed as a special education teacher at Coffenberry Middle 21 School in the South Umpqua School District from September 1988 to October 22, 1998, when he 22 was placed on administrative leave. Baumann subsequently resigned from his position with the 23 district. On or about October 21, 1998, Mr. Baumann sold methamphetamine, a controlled . 2 substance, to a narcotics team informant. The sale occurred in Mr. Baumann’s home in Myrtle ; 3 Creek, Oregon. As a result, he was indicted by a Douglas County Grand Jury on six drug related i 4 charges. On February 22, 2000, Mr. Baumann entered a plea of guilty to two of the counts in the i 5 indictment, Manufacture of a Controlled Substance and Delivery of a Controlled Substance. He 6 was sentenced in Douglas County Circuit Court to a term of 38 months in prison and 36 months 7 of post-prison supervision, 8 4. On January 2, 1999, Mr. Baumann was arrested and charged with Driving Under 9 the Influence. A toxicology examination and urine specimen revealed the presence of 10 methamphetamine in Mr. Baumann’s system. On January 28, 1999, Mr. Baumann was 11 convicted and granted diversion for DUI-Controlled Substance in Myrtle Creek Municipal Court. 12 5. On January 26, 1999, Mr. Baumann stuck an axe in the side of a residence located ‘ l3 in Roseburg, Oregon. He was subsequently charged with Criminal Mischief II, a misdemeanor, 14 in Roseburg Municipal Court. On May 3, 1999, he entered a plea of no contest to the charge in 15 Roseburg Municipal Court and was sentenced to 30 days in jail with 28 days suspended. 16 6. On April 15, 1999, while under indictment for the earlier drug related charges, 17 Mr. Baumann was arrested for possession/delivery of 10 grams of methamphetamines. He was 18 subsequently indicted by a Douglas County Grand Jury and on February 22, 2000, he entered a l9 plea of guilty to the crime of Delivery of a Controlled Substance. The court sentenced 20 Mr. Baumann to a term of 24 months in prison and 36 months of post-prison supervision to run 21 consecutively with the sentence on the earlier drug conviction. 22 /// 23 /// .
