' 1 BEFORE THE TEACHER STANDARDS AND PMCTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 5 In the Matter of the | 6 Teaching License of | DEFAULT ORDER 7 DAVID JASON BLISS \ OF REVOCATION 8 DOB: 09-08-66 l 9 10 11 On January l6, 2002, the Teacher Standards and Practices Commission issued a 12 Notice of Opportunity for Hearing to David Bliss, in which the Commission proposed to 13 suspend or revoke the teaching license of David Bliss or otherwise impose discipline under 14 ORS 342.177. The notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 15 #7001 0320 0005 0740 9503 to the address Mr. Bliss provided to the Commission. The 16 certified mailing was returned to the Commission as unclaimed. David Bliss wrote to the 17 Commission on February 4, 2002, stating “In regards to the request I received in the mail 18 about a hearing, I decline to arrange one. Thank you for the opportunity however.” O” 20 The Notice of Opportunity for Hearing, signed by David V. Myton, Executive 21 Director, stated: 22 If a request for hearing is not received within this 21-day period, your right to 23 hearing shall be considered waived unless your failure to request a hearing was 24 beyond your reasonable control. If you do no request a hearing or if you fail to 25 appear at a hearing, the Commission will adopt an Order of Default which may 26 include the revocation or suspension of your license or other discipline. 27 28 Based on the foregoing, the Commission finds David Bliss in default and such default 29 is hereby entered. Based on the records and files of the Commission, the Commission enters 30 the following findings of fact and order. 31 FINDINGS 0F FACT 32 1. David Jason Bliss holds a Restricted Transitional Teaching License with an 33 endorsement in Drama restricted to Gresharn-Barlow School District valid October 26, ' 34 2000, through October 26, 2003. ‘ PAGE l - DEFAULT ORDER OF REVOCATION-DAVID JASON BLISS ' 1 2. David Bliss was employed as a Drama Teacher at Gresham High School since 2 September 2000. He resigned from his position on March 28, 2001. 3 3. During the 2000-2001 academic year, David Bliss contacted students at school 4 to pose for photographs in the solicitation of his photography business. In February 2001, 1 5 he took photos of JG in his home and charged him $20 for the work. i 6 4. During the 2000-2001 academic year, David Bliss contacted sixteen year old 7 MK, a student, at Gresham Barlow High School and took MK to his home to pose partially 8 clothed for photographs to enhance his professional portfolio. 9 5. During the 2000-2001 academic year, David Bliss contacted sixteen year old 10 TJB, a student, at Gresham-B arlow High School and photographed TJB partially clothed 11 for photographs to enhance his professional portfolio. 12 13 CONCLUSIONS OF LAW 14 David Bliss’ actions constitute gross neglect of duty in violation of OAR 584-020- 15 0040(4)(o) and OAR 584-020-0035(b).
