' 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION I25 OF THE STATE OF OREGON g In the Matter of the ) 6 Teaching License of ) STIPULATION OF FACTS 7 JACK WAYNE FRY ) AND ORDER OF PROBATION g ) 10 On or about April 5, 2002, the Teacher Standards and Practices Commission 11 (Commission) received an application for a Transitional Teaching and Transitional 12 Administrator License from Jack Wayne Fry (Fry). Mr. Fry reported a criminal 13 conviction on in the character question section of Application for Educator Licensure 14 Form C-1. Mr. Fry provided extensive documentation of his conviction for Domestic 15 Battery on May 13, 1998, in the Justice Court of Sparks Township, Washoe County, .16 Nevada. Q 1 17 After review of the facts in this matter, Mr. Fry and the Executive Director agree 18 that their respective interests, together with the public interests, are best served by a 19 stipulation to certain facts and the issuance of licensure subject to a four (4) year 2O probation. 21 This Order sets forth the facts upon which the parties have agreed and the 22 sanction to be imposed. In entering into this stipulation, Mr. Fry waives the right to a 23 hearing to contest the findings of fact, conclusion of law and order set forth below. Mr. 24 Fry understands that the Commission will impose a four (4) year probation with specific 25 conditions. 26 This stipulation is contingent upon approval and adoption of the Order by the '27 Commission. On or about April 5, 2002, The Commission received an application for a 5 Transitional Teaching and Transitional Administrator License from Jack Wayne Fry. 6 2. Mr. Fry currently holds a Washington Teaching and Administrator License both 7 issued July 2, 2001, valid for five years. 8 3. On or about May 13, 1998, Mr. Fry was convicted of Domestic Battery in Justice 9 Court of Sparks Township for Washoe County Nevada. This was an alcohol related 1O incident. Mr. Fry participated in intensive alcohol rehabilitation and counseling as 11 required by the court. '12 4. Myton, Executi Director Date 19 CONCLUSION OF LAW 20 Jack Wayne Fry's criminal conviction for Domestic Battery on May 13, 1998, 21 constitutes Gross Unfitness as defined in OAR 580-020-0040(5)(c). 22 ORDER 23 The Commission adopts the above Findings of Fact and places Mr. Fry on 24 probation for four (4) years. ; . ' 1 The Commission authorizes issuance of a Transitional Teaching License and 2 Transitional Administrator License t0 Jack Wayne Fry subject to all standard terms and 3 conditions and subject to the following special terms of probation: 4 1. The Commission places Mr. Fry on a four (4) year probation to commence the 5 issuance date of a Transitional Teaching and Transitional Administrator License. 6 2. The probation shall remain in effect subject to the following conditions: 7 a. Mr. Fry shall conduct his self as a law-abiding citizen; 8 b. Mr. Fry shall report in writing within ten days to the Executive Director of the 9 Commission any arrest or citation for any felony, misdemeanor, major traffic 10 violation; 11 c. Mr. Fry shall continue to maintain his sobriety and abstain from consumption '12 of alcohol; and 13 d.
