I 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION “ OF THE STATE OF OREGON ’ In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 ROSCOE SEVENIOUS BLOUNT ) LICENSE REVOCATION 7 8 On August 26, 2004, the Teacher Standards and Practices Commission (Commission) issued 9 a Notice of Opportunity for Hearing to Roscoe Sevenious Blount (Blount) in which the Commission 10 charged him with misconduct under ORS 342.175. The Notice was sent via U.S. First Class Mail and . 1 1 U.S. Certified Mail Receipt 7003 2260 0000 8922 8357 to the address obtained by the Commission. 12 The certified mail receipt was not returned to the Commission. The Notice of Opportunity of Hearing, 13 dated August 26, 2004, and signed by Victoria Chamberlain, Executive Director, stated: 14 "You, Roscoe Sevenious Blount, are entitled to a hearing on the proposed action of the 15 Commission. If you want a hearing, you must file a written request for a hearing with 16 the Commission within 21 days of the date of this notice. Attached to this notice is a 17 copy of the procedures, right of representation and other rights of parties relating to the 18 conduct of a hearing as required under ORS 183.413(2)." 1 b Mr. Blount did not request a hearing. The Commission, therefore, finds 21 Mr. Blount to be in default and enters the following findings of fact, conclusions of law and 22 order, based on the files and records of the Commission concerning this matter. 23 FINDINGS 0F FACT 24 1. Mr. Blount holds a Transitional Teaching License with endorsements in Special Education, ‘ 25 issued December 28, 2001, valid until December 28, 2004. 2s 2. On January 22, 2004, while serving as a substitute teacher at the Pleasant Valley 27 Elementary School in Centennial School District, Mr. Blount used abusive, loud and angry language 28 towards students in an elementary school classroom. Mr. Blount also hit the students’ desk with a 29 stick in a threatening manner. l PAGE 1 — DEFAULT ORDER OF LICENSE REVOCATION — BLOUNT 1 3. On January 22, 2004, Mr. Blount failed to teach the lesson plan left by the regular class . teacher whom he was substituting for. Mr. Blount was disruptive and caused distrust in the students 3 by being loud, abusive and used unreasonable physical force on a student. 4 4. On January 22, 2004, Mr. Blount used unreasonable physical force when he grabbed a 5 student’s face with both hands and held the student's face near his. 6 5. On January 22, 2004, Mr. Blount used unreasonable physical force when he struck a 7 student on the head with his hand. Mr. Blount also called the student a derogatory name and pulled 8 items out of a student's desk onto the floor. 9 CONCLUSIONS OF LAW 10 Items one and four above constitute Gross Neglect of Duty in violation of OAR 584-020- 11 0040(4)(n) as it incorporates OAR 584-020~0025(1) and (2). Item two above constitutes Gross 12 Neglect of Duty in violation of OAR 584-020—0040(4)(n) as it incorporates OAR 584-020-0015(2)(b), 13 (c) and (e). Item three above constitutes Gross Neglect of Duty in violation of OAR 584-020- ’ 0040(4)(d). The Commission's authority to impose discipline in this matter is based upon ORS I 15 342.175.
