Under OAR 584-050-0020, the Commission informs the educator of 18 intent to suspend the license on the basis of such report. The Executive Director took 19 action to notify Michael Gillette of intent to suspend his license, and to inform him of his 20 opportunity for hearing by letter dated January 10, 2006. The letter was sent by Certified 21 Mail—Return Receipt Requested #7005 0390 0005 5794 8989. The receipt was signed 22 by Michael Gillette on January 26, 2006, and returned to TSPC. Michael Gillette did 23 request a hearing. 24 . 25 On May 9, 2006, the Commission conducted a contested case hearing to 26 determine whether Michael Gillette resigned his teaching position in violation of his 27 employment contract and ORS 342.553 by not first providing 60 days prior notice to 28 Grcsham-Barlow School District and without satisfactory justification. 29 3O The Teacher Standards and Practices Commission adopts the Findings of Fact, 31 Conclusion of Law and sanction contained in this Order. 32 33 34 FlNDINGS OF FACT 35 36 l. Michael Gillette was employed as a teacher for the Gresham-Barlow 37 School District during the 2005-2006 school year. 38 39 2. Mr. Gillette resigned from his teaching position in violation of his 40 employment contract without first providing 60 days’ prior notice to the district. 4| 42 3. Mr. Gillette did not provide satisfactory justification for violating is 43 contract.
