1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) AND FINAL ORDER OF 5 JASON PAUL STUBBS ) SURRENDER AND REVOCATION 6 On or about February 22, 2008, the Teacher Standards and Practices Commission _ 7 (Commission) received a report from Greg Thede, Superintendent, Klamath County School 8 District, indicating that Mr. Stubbs may have inappropriately touched a student. 9 Mr. Stubbs has fully cooperated with the TSPC investigation. After review of the matters 10 alleged, Mr. Stubbs and the Commission agree that their respective interests, together with the 11 public interest, are best sewed by a stipulation to certain facts and revocation of Mr. Stubbs’s 12 Oregon teaching license. 13 Mr. Stubbs agrees that the Commission has the authority to investigate the allegations 14 against him, make findings of fact and conclusions of law. Mr. Stubbs understands that the 15 Commission will rely upon these findings to revoke his license and waives his right to appeal the 16 revocation of his license. 17 This document sets forth the facts upon which the parties have agreed and the 18 stipulated sanction to be imposed. Mr. Stubbs stipulates that the TSPC has the statutory 19 authority to rely upon these facts to support this order and he will not contest this order. 20 By signing below, Mr. Stubbs acknowledges, understands, stipulates, and agrees to the 21 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 22 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 23 such rights and any rights to appeal or othenuise challenge this Stipulation of Facts, and Final 24 Order of Surrender and Revocation (Stipulation and Final Order); (ii) this Stipulation and Final 25 Order is a public document and disclosed to the public upon request by the Commission; 26 (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by 27 the Commission. lf the Commission does not approve and adopt this Stipulation and Final Page 1 STIPULATION OF FACTS, ORDER OF SURRENDER AND REVOCATION - STUBBS 1 Order, then neither Mr. Stubbs nor the Commission are bound by the terms herein; (iv) he has 2 fully read this Stipulation and Final Order, and understands it completely; (v) he voluntarily 3 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 4 Final Order below; (vi) he has consulted with an attorney regarding this Stipulation and Final 5 Order and has been fully advised with regard to his rights thereto, or waives any and all rights to 6 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and 7 entry of the stipulated Final Order below. -- . , ' 8 STIPULATION 0F FACTS ' 9 1. The Commission has licensed Mr. Stubbs since August 12, 2005. Mr. Stubbs holds a 1O Initial l Teaching License with an high school and career and technical education program 11 endorsement in Agricultural Science and Technology endorsement, issued August 12, 2005 that 12 expires March 16, 2009. 13 2. Mr. Stubbs began employment with Klamath County School District in 2005 serving 14 at Henley High School. Mr. Stubbs resigned at the end of the 2008 school year. 15 3. On February 11, 2008 a 15 year-old Henley High School female student reported that 16 Mr. Stubbs touched her buttocks. Mr. Stubbs denied the allegations. 17 4. On October 16, 2008 Mr. Stubbs was convicted of Offlcial Misconduct. Charges of 18 Sexual Abuse 3 and Harassment were dropped. The above . 4 described conduct further constitutes gross neglect of duty under ORS 342.175(1)(b), in ‘ 5 violation of OAR 584-020-0040(4)(0) as it incorporates OAR 584-020-0035(1)(c)(D).
