1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION Q OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) ORDER OF REPRIMAND 5 DAMON JAMES SCHRADER ) 6 On or about July 27, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a complete application fora Transitional Teaching License from Damon 8 James Schrader (Schrader). In the character question section of the application Mr. Schrader 9 responded “no” to all questions. A fingerprint inquiry and response from the Federal Bureau of 10 Investigation (FBI) revealed that Mr. Schrader was arrested on February 20, 1990, for 11 Possession of Marijuana in Phoenix, Arizona. 12 Mr. Schrader fully cooperated with the Commission’s investigation. After review of the 13 matters alleged, Mr. Schrader and the Commission agree that their respective interests, 4 together with the public interest, are best served by a stipulation to certain facts and the Q imposition of a Public Reprimand. 16 This Order sets forth the facts upon which the parties have agreed and the sanction to 17 be imposed. Mr. Schrader stipulates that there are sufficient facts contained in the 18 Commission's files and records to support the findings of fact and conclusions of law set forth 19 below. In entering into this stipulation, Mr. Schrader waives the right to a hearing to contest the ‘20 finding of fact, conclusion of law and order set forth below. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Schrader nor the 23 Commission are bound by these stipulations, and Mr. Schrader retains all rights to a hearing on 24 the allegations. 25 STIPULATION OF FACTS 26 1. On July 27, 2005, the Commission received an Application for Educator License . Form C-1 requesting a Transitional Teaching License from Mr. Schrader. Mr. Schrader Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND - SCHRADER 1 responded “no” to all character questions including number 8, “Have you ever been convicted or Q been granted conditional discharge by any court for: (a) any felony; (b) misdemeanor...'?" 3 Mr. Schrader failed to disclose and provide court documents regarding his conviction. 4 2. On October 13, 2005, Mr. Schrader submitted documents indicating that the original 5 charge was reduced by the court. On March 22, 1990, Mr. Schrader pled guilty and was 6 convicted of misdemeanor possession of marijuana in the Wickenburg Justice Court Precinct, 7 County of Maricopa, State of Arizona. 8 ITIS OSTIP .T : 9 sfii [A L M I? The conviction, in addition to Mr. Schrader’s failure to 18 disclose it, are basis for denial of licensure pursuant to OAR 584-050-0006(1) and (3). The 19 Commission’s authority to impose discipline in this matter is based upon ORS 342.175. 20 ORDER 21 The Commission hereby adopts the above stipulation of facts and imposes a Public 22 Reprimand on Mr. Schrader.
