l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF S Educator License of ) REVOCATION OF 6 BEAUDOIN, WILLIAM GEORGE ) RIGHT TO APPLY 7 8 On September 5, 2014, the Teacher Standards and Practices Commission 9 (Commission) issued a Notice of Opportunity for Hearing to William George Beaudoin 10 (Beaudoin) in which the Commission charged him with Gross Neglect of Duty. The Notice 11 was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7012 1010 0003 2804 i 12 4623 to the address on file with the Commission. The Notice designated the Commission 13 file as the record for purposes of proving a prima facie case. Both the Certified Mail and the l4 regular mail was not returned to the Commission. The Notice of Opportunity of Hearing, 15 dated September 5, 2014, and signed by Victoria Chamberlain, Executive Director, stated: 16 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY l7 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED 18 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR l9 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF YOU 20 FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN ORDER 21 OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR SUSPENSION OF 22 YOUR LICENSE OR OTHER DISCIPLINE.” 23 24 Beaudoin did not request a hearing. The Commission, therefore, finds Beaudoin t0 be in 25 default and enters the following findings of fact, conclusions of law, and final order, based 26 on the files and records of the Commission concerning this matter. 27 28 FINDINGS OF FACT 29 1. William Beaudoin has been licensed by the Commission since June 23, 2011. 30 Beaudoin’s Transitional Administrator License with an endorsement in Administrator 31 (ALL LVL), was issued June 23, 2011, and expired on June 23, 2014. During all relevant 32 times, Beaudoin was employed by the Blachly School District, also known as the 33 Triangle Lake Charter School. 34 2. On August 29, 2013, the Commission received a report indicating Beaudoin had 35 violated professional standards established by the Commission. Specifically, Beaudoin 36 assigned employees to teach courses for which they were not properly licensed 0r 37 registered to teach, including himself. Investigation determined that during the 2011- PAGE 1-DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY - BEAUDOIN, WILLIAM GEORGE if i . 1 2012 school year, Beaudoin assigned Lisa Lee Wagner to teach career classes without , 2 either a valid teaching license or a valid charter school registration. It was further l 3 determined that Beaudoin assigned Debra Werner to teach a culinary arts course 4 during the 2012-2013 school year. At no time, while Werner taught this course, did she 5 have a valid teaching license or a valid charter school registration. It was also 6 determined that during the fall of 2012, Beaudoin assigned himself to teach an elective 7 class when Beaudoin did not have a valid teaching license or charter school registration 8 that allowed Beaudoin to teach such course work. In the course of the C0mmission’s 9 investigation, Beaudoin misrepresented his knowledge of the mentioned 1 0 misassignments. l l CONCLUSIONS OF LAW 12 Beaudoin’s conduct constitutes gross neglect of duty in violation of ORS 13 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-001o(5) (Use 14 professional judgment); OAR 584-020-oo4o(4)(o) as it incorporates OAR 584-020- 15 0035(2)(a) (Apply for, accept, ofler, or assign a position ofresponsibility on the basis 0f 16 professional qualifications, and will adhere to the conditions of a contract or the terms 0f 17 the appointment); OAR 584-020-0040(4)(c) (Falsification of any document or knowing 18 misrepresentation directly related t0 Iicensure, employment, or professional duties); and 19 OAR 584-020-0040(4)(i) (Assigning an educator in violation of licensure requirements). 20 21 The Commission’s authority t0 impose discipline in this matter is based upon ORS 342.175. 22 ' 23 FINAL ORDER 24 The Commission hereby revokes William George Beaudoin’s right to apply for 25 licensure. 26 IT IS SO ORDERED THIS fliy of January, 2015 27 TEACHER STANDARDS AND PRACTICES COMMISSION 28 By: W 29 Victoria Chamberlain, Executive Director PAGE 2-DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY - BEAUDOlN, WILLIAM GEORGE 1 NOTICE OF APPEAL OR RIGHTS 2 3 YOU ARE ENTITLED TO JUDICIAL REVIEW OF THIS ORDER.
