Hall reported on a C-1 Application for Renewal that he 13 was convicted of Criminal Trespass l and Criminal Mischief lIl in Jackson County Circuit ' 14 Court on October 18, 1998. After review of the facts in this matter, Hall and the . 15 Executive Director agree that their respective interests, together with the public interest, . 16 are best served by a stipulation to certain facts, a reprimand followed by a probation of I17 two (2) years. This Order sets forth the facts upon which the parties have agreed and 18 the sanction to be imposed. In entering into this stipulation, Hall waives the right to a 19 hearing to contest the findings of fact, conclusion of law and order set forth below. 20 FINDINGS OF FACT 21 1. On or about October 29, 1997, the Commission issued a Basic Teaching License to 22 Duane Hall. Hall's Basic License expired on February 6, 2001. 23 2. Hall is employed as a Juvenile Detention teacher for the Medford School District. 24 3. On or about October 19, 1998, Duane Hall was convicted of the misdemeanor crime 25 of ORS 164.255, Criminal Trespass l in Jackson County Circuit Court (case 26 #983686MI count I). 27 4. On or about October 19, 1998, Duane Hall was convicted of the misdemeanor crime 28 of ORS 164.345, Criminal Mischief IlI in Jackson County Circuit Court (case 29 #983686MI count 2). Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION 1 5. Upon sentencing the Court ordered Hall to pay $500.00 in fines. ' 2 6. Hall has no prior or subsequent criminal convictions. 3 Hall understands that the Commission will impose a two (2) year probation with 4 specific conditions. 5 This stipulation is contingent upon approval and adoption 0f the Order by the 6 Commission. Myton, Executiv Director Date 15 CONCLUSION 0F LAW 16 Duane Scott Hall’s criminal convictions for ORS 164.255, Criminal Trespass I; 17 and ORS 164.355, Criminal Mischief Ill, constitute gross unfitness as defined in OAR 18 580-020-0040(5)(c). 19 ORDER 20 The Commission adopts the above Findings of Fact and orders a Public 21 Reprimand for conviction of the crime of Criminal Trespass I as defined by ORS 22 164.255; and Criminal Mischief Ill as defined by ORS 164.355. This Order shall serve 23 as the Public Reprimand. 24 The Commission authorizes issuance of a Basic Teaching License to Duane ~25 Scott Hall subject to any endorsements or authorizations thereon and subject to the 26 following special terms of probation: Page 2 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION 1 1. The Commission places Hall on a two (2) year probation to commence May 10, ' 2 2001. 3 2. The probation shall remain in effect subject to the following conditions: 4 a. Hall shall conduct himself as a law-abiding citizen; 5 b. Hall shall report in writing within ten days to the Executive Director of the 6 Commission any arrest or citation for any felony, misdemeanor, or major 7 traffic violation; and _ 8 c. Hall shall comply with the Standards for Competent and Ethical Performance 9 of Oregon Educators under OAR 584, Division 20.
