1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 5 1’ 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) STIPULATION OF FACTS 5 Teaching License of ) AND ORDER OF REPRIMAND 6 BRADLEY KEVIN CONWAY ) g ' ) 9 On or about January 31, 2001, the Teacher Standards and Practices 10 Commission (Commission) issued a Notice of Opportunity for Hearing to Bradley Kevin 11 Conway (Conway) in which the Commission proposed to take disciplinary action against 12 Conway under ORS 342.175 through 342.190. The basis of the proposed action arose 13 out of an investigation by the Commission after Skip Liebertz, Superintendent, 14 Willamette ESD reported that Conway failed to make a mandatory report of child abuse I 515 under ORS 4195.010 while serving as a licensed educator at Robert Farrell High 16 School. 17 After review of the matters alleged, Conway and the Commission agree that their 18 respective interests, together with the public interest, are best served by a stipulation to 19 certain facts and the imposition of a Public Reprimand. This Order sets forth the facts 20 upon which the parties have agreed and the sanction to be imposed. In entering into 21 this stipulation, Conway waives the right to a hearing to contest the finding of fact, 22 conclusion of law and order set forth below. 23 24 STIPULATION OF FACTS 25 1. The Commission issued a Basic Teaching License to Bradley Kevin Conway ‘26 on August 15, 1997 valid until December 12, 2000. The Commission has not previously 27 received a complaint concerning Conway or taken disciplinary action against him. Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND _ CONWAY 1 2. On or about August 8, 2000, a female student attending Robert Farrell High . 2 School gave Conway a written statement indicating that she was afraid of men and that 3 she had been physically abused by her father and sexually abused by her brother. 4 3. As a school employee, Conway had a legal duty to under ORS 4198.010 to 5 report suspected child abuse to the State Office for Services to Children and Families 6 (SCF) or to a law enforcement agency. 7 4. Conway failed to immediately report child abuse as required and defined in 8 ORS 419B. Conway accepts responsibility for his behavior and acknowledges his 9 failure to report was inappropriate. 10 Conway enters into this Stipulation of Facts with the knowledge that the Teacher 11 Standards and Practices Commission will adopt an Order of Public Reprimand for 12 neglect of duty. This Stipulation is contingent upon approval and adoption of the Order ‘13 by the Commission.
