1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) STIPULATION OF FACTS, 5 DAVID GRANT KOHL ) SURRENDER, AND 6 ) ORDER OF REVOCATION Z; On or about March 17, 2001, the Teacher Standards and Practices Commission 9 (Commission) received information in the form of a newspaper article published in the 10 Oregonian. The newspaper article indicated that David Grant Kohl, a teacher, had been 11 charged, in Clackamas County, with first-degree sexual abuse involving a male student. 12 Mr. Kohl fully cooperated with the Commission's investigation. After review of 13 the matters alleged, Mr. Kohl and the Commission agree that their respective interests, 14 together with the public interest, are best served by a stipulation to certain facts and . 15 surrender of his teaching license as per OAR 584-050-0027. t 16 This Order sets forth the facts upon which the parties have agreed and the 17 sanction to be imposed. In entering into this stipulation, Mr. Kohl waives the right to a 18 hearing to contest the finding of fact, conclusion of law and order set forth below. Mr. 19 Kohl understands that the Commission will revoke his right to apply for a teaching 20 license. 21 STIPULATION 0F FACTS 22 1. Mr. Kohl has been licensed by the Commission since October 21, 1980. Mr. 23 Kohl held a Standard Teaching License with a Standard Art Endorsement valid from 24 September 20, 1996 until expiration October 8, 2001. There are no previous complaints 25 against Mr. Kohl on file with the Commission. 26 2. Mr. Kohl was employed by North Clackamas School District as a teacher at 27 McLoughlin Middle School from 1982 until his resignation effective June 30, 2001. Page 1 STIPULATION OF FACTS, SURRENDER, AND ORDER OF REVOCATION - KOHL 1 3. On January 15, 2002, Mr. Kohl was convicted in Clackamas County Circuit ' 2 Court for the crime of Harassment, ORS 166.065. The Court placed Mr. Kohl on 3 probation for 60 months with special probation conditions, including, but not limited to, 4 “1. Have no contact with any female or male under the age of 18, unless authorized in 5 writing by a probation officer.” 6 4. The charge of first-degree sex abuse was dismissed on January 15, 2002, in 7 Clackamas County Circuit Court. 8 This stipulation is contingent upon approval and adoption of the Order by the 9 Commission. If the Commission does not adopt this Order, neither Mr. Kohl nor the 10 Commission are bound by these Stipulations and Mr. Kohl retains all rights to a hearing 11 on the allegations. 12 CONCLUSION OF LAW . 13 Conviction of violating any state law OAR 580-020-0040(5)(c) constitutes Gross 14 Unfitness. However, David Grant Kohl was convicted of Harassment ORS 166.065 as a 15 result of his behavior towards a student in the classroom. This misconduct constitutes 16 Gross Neglect of Duty.
