1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 RIKI RICHELLE ANDERSON ) ORDER OF REPRIMAND 6 On or about September 2, 2005, the Teacher Standards and Practices Commission 7 (Commission) received an application for renewal of a Basic Teaching License from Riki R. 8 Anderson (Anderson). The North Powder and Burnt River School Districts submitted I 9 Professional Education Experience Report (PEER) forms indicating that Anderson served as 10 Special Education teacher during school years in which she did not hold a Special Education 11 Endorsement. 12 Ms. Anderson fully cooperated with the Commission’s investigation. After review of the 13 matters alleged, Ms. Anderson and the Executive Director agree that their respective interests, 14 together with the public interest, are best served by a stipulation to certain facts and a public it's reprimand. 16 This Order sets forth the facts upon which the parties have agreed and the sanction to 17 be imposed. Ms. Anderson stipulates that there are sufficient facts contained in the 18 Commission‘s tiles and records to support the findings of fact and conclusions of law set forth 19 below. In entering into this stipulation, Ms. Anderson waives the right to a hearing to contest the 20 findings of fact, conclusion of law and order set forth below. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Ms. Anderson nor the 23 Commission are bound by these Stipulations, and Ms. Anderson retains all rights to a hearing 24 on the allegations. 25 /// 26 /// - O Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND — ANDERSON 1 STIPULATION OF FACTS . 2 1. On September 6, 1995, the Commission issued Ms. Anderson a Basic Teaching 3 License with Basic Elementary Endorsement. 4 2. In September of 1996 Ms. Anderson applied for a special education teaching 5 position and was hired by the Burnt River School District to teach special education. 6 Ms. Anderson enrolled in a special education program at Eastern Oregon University in January 7 ot 1997. The District applied for and was granted Misassignments for Ms. Anderson to teach 8 special education during the 1996-1997, 1997-1998 and 1998-1999 school years. 9 Ms. Anderson taught special education at Burnt River School District without an endorsement, 10 or a Conditional Assignment Permit during the 1999-2000, 2000-2001 school years. On 11 September 30, 2001, the Commission authorized a one-year Conditional Assignment Permit for 12 Ms. Anderson to teach the 2001 -2002 school year. 13 3. On January 8, 2002, the Commission renewed Ms. Anderson's Basic Teaching .‘4 License with Basic Elementary Endorsement valid through September 8, 2005, and instructed 15 Burnt River School District to request an emergency license for Ms. Anderson to allow her to 16 teach special education while she completed her special education program at Eastern Oregon 17 University. Burnt River School District did not request said emergency license. Ms. Anderson 18 continued to teach special education at Burnt River School District without a Special Education 19 Endorsement during the 2002-2003 and 2003-2004 school years. 20 4. On May 3, 2004, the Commission received a Program Completion Report (C2) from 21 Eastern Oregon University indicating that Ms. Anderson completed her program on November 22 23, 2002. 23 5. On June 12, 2004, Ms. Anderson applied for a special education teaching position 24 with the North Powder School District. Ms. Anderson indicated on her Oregon Statewide 25 Teacher Application that she held a Basic License, under Endorsements she wrote, “Special .6 Education — Basic (currently processing through TSPC)". i Page 2 STIPULATION OF FACTS AND ORDER OF REPRIMAND — ANDERSON ‘ 1 1 6. On July 7, 2004, The Commission sent Ms. Anderson an email indicating that she . 2 must make application to add the Special Education Endorsement to her Basic Teaching 3 License. 4 7. Ms. Anderson taught special education for the North Powder School District for the 5 2004-2005 school year and the 2005-2006 school year, through December 1, 2005, without a 6 Special Education Endorsement. 7 8. There is no evidence that Ms. Anderson intentionally misrepresented her licensure to 8 a school district or the Commission. Anderson served without proper licensure in violation of OAR 584-050-0030(2) 20 during the 1999-2000, 2000-2001, 2002-2003, 2003-2004, 2004-2005 and 2005-06 school 21 years. This misconduct constitutes Gross Neglect of Duty. Anderson.
