1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION g OF THE STATE OF OREGON g In the Matter of the ) 4 6 Teaching License of ) STIPULATION OF FACTS, 7 CHRYSTE LEA FRAUENDIENER ) ORDER OF REPRIMAND AND a ) PROBATION 9 10 On or about October 22, 1999, the Teacher Standards and Practices 11 Commission (Commission) received a report from Rick O'Dell, Program Manager for J 12 Bar J Youth Services, an Oregon Youth Authority facility, indicating that Chryste 13 Frauendiener was under investigation by Oregon State Police for custodial interference. 14 Mr. O’Dell also indicated that Ms. Frauendiener exhibited poor boundaries with 15 students. 16 On or about July 20, 2000, the Commission received a report from Douglas 17 Nelson, Superintendent, Bend-La Pine School District indicating that Chryste 18 Frauendiener was under investigation by the District for alleged misconduct and that he 19 was concerned about her sense of appropriate boundaries. 20 On or about July 13, 2001, the Commission received an application for renewal 21 of a Basic Teaching License from Chryste Lea Frauendiener. Ms. Frauendiener 22 reported on a C-1 Application for Renewal that she had left her employment 23 involuntarily while the subject of an Oregon State Police investigation at J Bar J Youth 24 Services. 25 After review of the facts in this matter, Ms. Frauendiener and the Executive 26 Director agree that their respective interests, together with the public interest, are best 27 served by a stipulation to certain facts, a reprimand followed by a probation of two (2) 3'8 years. Ms. Frauendiener understands that the Commission will impose a two (2) year 29 probation with specific conditions. This Order sets forth the facts upon which the parties Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - FRAUENDIENER 1 have agreed and the sanction to be imposed. In entering into this stipulation, Ms. . 2 Frauendiener waives the right to a hearing to contest the findings of fact, conclusion of 3 law and order set forth below. 4 This stipulation is contingent upon approval and adoption of the Order by the 5 Commission. If the Commission does not adopt this Order, neither Ms. Frauendiener 6 nor the Commission are bound by these Stipulations and Ms. Frauendiener retains all 7 rights to a hearing on the allegations. ~ 8 STIPULATION OF FACT ' 9 1. On or about August 11, 1998, the Commission issued a Basic Teaching License to 1O Chryste Frauendiener. Ms. Frauendiener’s Basic Teaching License expired on 11 December 21, 2001. 12 2. Ms. Frauendiener was employed as a teacher for the J Bar J Youth Services in '13 Bend, Oregon , from February 25, 1999 to May 28, 1999. On or about May 28, 14 1999, she was terminated for providing transportation to a resident, assisting him in 15 an unauthorized departure from the facility. NO criminal charges were filed in this 16 matter. Ms. Frauendiener entered into a Diversion agreement with the Deschutes 17 County District Attorney‘s Office. Said Diversion agreement required Ms. 18 Frauendiener to complete a psychological evaluation regarding whether she is at 19 risk or demonstrates a need for psycho-sexual treatment, notify her employer and 20 pay a $100.00 Diversion fee. Ms. Frauendiener satisfactorily completed the terms 21 and conditions of the Diversion agreement. 22 3. Chryste Frauendiener was employed by the Bend-LaPine School District as a middle 23 school teacher during the 1999-2000 academic year on a one-year temporary '24 contract. On June 9, 2000, the District placed Ms. Frauendiener on paid 25 administrative leave and initiated an investigation based upon concerns of Page 2 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - FRAUENDIENER 1 appropriate student-teacher boundaries. Ms. Frauendiener violated Bend-La Pine ' 2 School District Policy regarding the transportation of students in her personal vehicle 3 on a number of occasions by failing to obtain written permission from a parent. _ 4 4. In September of 2001, Ms. Frauendiener was hired by the North Lake School 5 District. She is currently teaching in that District at both the middle school and high 6 school levels. 7 5. M n, Exe u ive Director Date _ 14 .15 CONCLUSION OF LAW ' 16 Chryste Lea Frauendiener violated Standards for Competent and Ethical 17 Performance of Oregon Educators, OAR 584-020-0023(2)(e), when she failed to 18 demonstrate skill using district lawful and reasonable rules and regulations by 19 transporting students in her personal vehicle while employed at J Bar J Youth Services 20 and Bend-La Pine School District. Ms. Frauendienefs behavior constitutes Neglect of 21 Duty as defined in OAR 584-020-0040(4)(n). 22 ORDER 23 The Commission adopts the above Stipulation of Fact and imposes a Public 24 Reprimand. This Order shall serve as the Public Reprimand. The Commission 25 authorizes issuance of a Basic Teaching License to Chryste Lea Frauendiener subject '26 to any endorsements or authorizations thereon. Furthermore the Commission imposes Page 3 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - FRAUENDIENER 1 a two (2) year probation upon Ms. Frauendiener to commence March 8, 2002, subject to I ' 2 the following special terms of probation: 3 1. Ms. Frauendiener shall at her own expense, participate in an intensive 4 education/counseling program regarding appropriate boundaries with students 5 conducted by a qualified trainer/counselor approved in advance by the Commission. 6 This intensive training program shall consist of, at least, eight (8) one (1) hour sessions. ~ 7 The educator will provide the trainer/counselor with a copy of this Order together with 8 copies of all police reports and district investigation notes. 9 2. Ms. Frauendiener shall complete the education/counseling program prior to 10 March 8. 2003. The trainer/counselor will provide the Commission with a report of 11 successful completion. 12 3.
