‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 LLOYD RAY HARTLEY ) ORDER OF REPRIMAND 6 On March 19, 2003, the Teacher Standards and Practices Commission 7 (Commission) received a complaint from Toni M. Clark alleging that Lloyd Ray Hartley 8 (Hartley) failed to make immediate notification CSD or the sheriff's office upon receipt of 9 information that a female student was subjected to offensive physical contact by the 1O husband of the girls‘ dormitory supervisor. 11 Mr. Hartley fully cooperated with the Commission's investigation. After review of 12 the matters alleged, Mr. Hartley and the Commission agree that their respective interests, together with the public interest, are best served by a stipulation to certain Q facts and an imposition of a Public Reprimand. 15 This Order sets forth the facts upon which the parties have agreed and the 16 sanction to be imposed. Mr. Hartley stipulates that there are sufficient facts contained 17 in the Commission’s files and records to support the findings of fact and conclusions of 18 law set forth below. In entering into this stipulation, Mr. Hartley waives the right to a 19 hearing to contest the findings of fact, conclusions of law and order set forth below. 2O This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Hartley nor the 22 Commission are bound by these stipulations, and Mr. Hartley retains all rights to a 23 hearing on the allegations. 24 / // O Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND — HARTLEY ‘1 STIPULATION OF FACTS 2 1. The Commission has licensed Lloyd Ray Hartley since July 30, 1998. 3 Mr. Hartley currently holds a Basic Teaching License issued January 29, 2002, valid 4 until February 16, 2005, with a Standard General Business Education Endorsement and 5 an Initial Administrative License issued July 10, 2002, valid until February 16, 2006, with 6 an Administrator Endorsement. 7 2. Mr. Hartley is the Superintendent of Long Creek School District. The Long 8 Creek School district operates a boarding school that accepts foreign students. 9 3. On January 2, 2003, four female students living in the Long Creek School 10 District Dormitory met with Mr. Hartley. OS told Mr. Hartley that that the “dorm father’, 11 husband of the girls‘ dormitory supervisor, rubbed her back, gave her goodnight hugs and touched her leg. OS told Mr. Hartley that this behavior was unwelcome and that ‘3 she wanted this behavior to stop. Mr. Hartley did not make a mandatory immediate 14 report pursuant to ORS 419.0108. 15 4. On January 3, 2003 Mr. Hartley received a transcript of an MSN Chat 16 communication between a male student and, OS a female student (from the Ukraine), 17 who lived in a Long Creek School District Dormitory that occurred on or about 18 December 27, 2002. The transcript indicates that the female student, OS, felt 19 uncomfortable about physical contact initiated by the husband of the girls’ dormitory 2O supervisor. OS indicated that this man hugged her, kissed her and touched her 21 inappropriately in the leg and that this man touched the other girls. OS also indicated 22 that she was afraid to tell the supen/isor‘s husband to stop touching her. 23 5. Mr. Hartley failed to make'a mandatory report 13 pursuant to ORS 419.0105 in violation of OAR 584-020-0010(5) which requires that the ' administrator demonstrate a commitment to use professional judgment. This failure to 15 demonstrate a commitment to use professional judgment constitutes Gross Neglect of 16 Duty. The Commission's authority to impose discipline in this matter is based upon 17 ORS 342.175. 18 /// 19 /// 20 /// O Page 3 STIPULATION OF FACTS AND ORDER OF REPRIMAND — HARTLEY ‘ ORDER 2 The Commission hereby adopts the above findings of fact and imposes a Public 3 Reprimand upon the Licensure of Lloyd Ray Hartley.
