‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) STIPULATION OF FACTS, Teaching License of ) AND ORDER OF SUSPENSION GLORIA JACKSON ) AND PROBATION I On or about April 3, 1997, the Teacher Standards and Practices Commission (Commission) issued a Notice of Opportunity for Hearing to Gloria Jackson (Jackson) in which the Commission proposed to suspend or revoke the teaching license of Jackson or otherwise impose discipline under ORS 342.177 based upon alleged misconduct involving (1) Jackson's convictions for theft and unlawfully obtaining public assistance and (2) Jackson's failures to report those convictions ‘on an employment application and on applications for teaching licenses. Jackson requested a hearing through her attorney, John S. Bishop, to contest the allegations in the Notice. After a review of the matters alleged, the parties have agreed that their respective interests, together with the public interest, are best served by the suspension of Jackson's license and a stipulation of certain facts and conclusions of law. This agreement sets out the facts upon which the parties have agreed and the sanctions to be imposed, and the basis for the Commission's order. In entering into this Stipulation, Jackson waives her right to a hearing to contest any of the findings set forth below. STIPULATED FACTS Jackson agrees and stipulates that substantial evidence exists in the record to support the following findings of fact by the Commission: 1. On or about February 23, 1978, Jackson pled no contest and was convicted of the crime of Theft in the First Degree, a Class A misdemeanor, by the Circuit Court of Oregon, Multnomah County. 2. On January 20, 1981 , Jackson pled guilty and was convicted of the crime of Unlawfully Obtaining Public Assistance by the Circuit Court of Oregon, Multnomah County. 3. On each of six applications for an Oregon teaching license (Form C-1), dated July 7, 1980, October 21, 1981, January 21, 1985, December 29, 1985, November 30, 1992, and November 9, 1995, ‘respectively, Jackson stated that she had never been convicted of a misdemeanor, felony, or major traffic violation. 4. On her application for employment with the Portland Public Schools, dated February 19, 1980, Jackson stated that she had never been convicted of an ,, Page 1 -- STIPULATION OF FACTS, AND ORDER OF SUSPENSION AND PROBATION . offense other than a minor traffic violation. 5. This Stipulation and the proposed order are contingent upon approval by the full Commission at the Commission's next meeting. If the Commission does not approve this Stipulation, the matter will be returned for a hearing, and neither _ Jackson nor the Commission shall be bound by any matters in this Stipulation. CONCLUSIONS OF LAW Jackson's failures to disclose her convictions for theft and unlawfully obtaining public assistance constitute gross neglect of duty under ORS 342.175 and OAR 580-20-040. The parties acknowledge that upon execution of this Stipulation, the Commission wiII enter into an order reprimanding Jackson, suspending Jackson's teaching license from July 1, 1997 through July 31, 1997 and placing Jackson 0n probation with the Commission for three years thereafter. The Commission imposes a public reprimand, and this Order shall serve as the public reprimand. 2. The teaching license of Gloria Jackson is suspended from Juiy 1, 1997 through July 31, 1997. At any time after July 31 , 1997, Jackson may apply for reinstatement of her license by submitting to the Commission the required application forms and reinstatement fee. After processing the application for reinstatement, the Commission will, in the absence of any information that Jackson has failed to conduct herself as a law abiding citizen, reinstate Jackson's license under the probationary status described in paragraph 3 below. 3. The probationary status shall commence on the date of reinstatement of Jackson's license and shall remain in effect for a period of three years thereafter subject to the following conditions: . Jackson shall report in writing within ten days to the Executive Secretary of the Commission any arrest or citation Jackson receives for any felony, misdemeanor, or major traffic violation. c. Jackson shall comply with the Standards for Competent and Ethical Performance of Oregon Educators under OAR 584, Division 20. Violation of any of the terms of probation shall constitute an independent basis for the Commission to revoke Jackson's probationary license or otherwise impose discipline, after first providing Jackson with notice and opportunity for hearing.
