1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION Q OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 KENNETH LENNOX RANSOM ) AND PROBATION 6 On September 23, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from Kay Baker, Superintendent, Salem-Keizer Public Schools 8 alleging that Kenneth Lennox Ransom (Ransom) made a false statement on the District's 9 Criminal History Background Statement. 10 Mr. Ransom fully cooperated with the Commission's investigation in this matter. After 11 review of the matters alleged, Mr. Ransom and the Commission agree that their respective 12 interests, together with the public interest, are best served by a stipulation to certain facts, a 13 reprimand followed by a three (3) year probation. Mr. Ransom understands that the probation will be subject to specific terms and conditions. d This document sets forth the facts upon which the parties have agreed and the 16 stipulated sanction to be imposed. Mr. Ransom stipulates that there is sufficient evidence in the 17 Commission's files and records to support the findings of fact, conclusions of law, and order set 18 forth below. 19 By signing below, Mr. Ransom acknowledges, understands, stipulates, and agrees to 20 the following: (i) he has been fully advised of his rights to notice and a hearing to contest the 21 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 22 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Final Order ‘ 23 of Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is 1 24 a public document and disclosed to the public upon request by the Commission; (iii) this I 25 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 6 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. Ransom nor the Commission are bound by the terms herein; (iv) he has fully Page 1 — STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - RANSOM 1 read this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without Q any force or duress, enters into this Stipulation and Final Order and consents to issuance and 3 entry of the Stipulated Final Order below; (vi) he states that no promises or representation has 4 been made to induce his to sign this Stipulation and Final Order; and (vii) he has consulted with 5 an attorney regarding this Stipulation and Final Order and has been fully advised with regard to 6 his rights thereto, or waives any and all rights to consult with an attorney prior to entering into 7 this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 8 STIPULATION OF FACTS 9 1. The Commission licensed Kenneth Lennox Ransom beginning May 6, 1985. 1O Mr. Ransom currently holds a Standard Teaching License issued April 5, 2005, valid through 11 April 4, 2010, with a Standard Advanced Mathematics Endorsement. 12 2. Mr. Ransom began employment with Salem-Keizer Public Schools on August 14, 2001, and is currently assigned to North Salem High School teaching mathematics. it 3. On May 20, 2004, Mr. Ransom was detained by a store loss prevention officer for 15 taking a bottle of beer without paying and was trespassed from the store. 16 4. On June 29, 2004, Mr. Ransom accepted responsibility for taking a bottle of beer 17 without paying and plead guilty to and was convicted of one count of Theft lll (Violation), in the 18 Circuit Court of the State of Oregon for Marion County. 19 5. Mr. Ransom recognizes that he has an alcohol dependency problem and has agreed 20 to a plan of treatment and aftercare as prescribed by his treatment provider. 21 IT IS O STIPULATED ND AGREED TO: 22 M _./__,LL__’7 2 7 0 é 23 th ennox nsom < Date r, 25 Victoria C a rlain, Executive Director Date 26 Teacher Standards and Practices Commission O Page 2 - STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - RANSOM 1 CONCLUSIONS OF LAW Q Kenneth Lennox Ransom‘s alcohol related conviction and criminal conduct constitute 3 Gross Unfitness as defined in OAR 584-020-0040(5)(c) and OAR 584-020-0040(5)(e). The 4 Commission has the authority to impose discipline in this matter is based upon ORS 342.120 5 through 342.430 and OAR Chapter 584. 6 FINAL ORDER 7 The Commission hereby adopts and incorporates herein the above findings of fact and 8 conclusions of law and hereby imposes a Public Reprimand on Kenneth Lennox Ransom. This 9 Order shall serve as the Public Reprimand. 10 Furthermore, the Commission places Mr. Ransom on Probation for a period of three (3) 11 years probation subject to the following terms and conditions: 12 1. Mr. Ransom shall, at his own initiative and expense, continue to obtain treatment for 3 his alcohol dependency as recommended by his alcohol treatment provider and abstain from ‘4 the consumption of alcohol; 15 2. During the period of this probation, Mr. Ransom shall submit to the Executive Director 16 of the Commission reports of his compliance with the aftercare treatment plan. Mr. Ransom 17 shall provide these reports every six (6) months during his probation, on or before: July 11, 18 2007; January 11, 2008; July 11, 2008; January 11, 2009; July 11, 2009; and January 11, 2010. 19 3. Mr. Ransom shall report in writing within ten days to the Executive Director of the 20 Commission any arrest or citation for any felony, misdemeanor, major traffic violation or 21 violation of criminal probation; and 22 4.
