7 On May 23, 2006, the Teacher Standards and Practices Commission (Commission)

8 issued a Notice of Opportunity for Hearing to Troy Randolph Meling (Meling) in which the

9 Commission charged him with conviction of the Federal crime of Possession of Child
10 Pornography, 18 USC § 2252A(a)(5)(B) and 2252A(b)(2), The Notice was sent via U.S. First
I I Class Mail and U.S. Certified Mail Receipt #7005 0390 0005 5794 9214 to the address obtained
12 by the Commission. The U.S. Certified Mailing receipt was signed by Pat Meling and returned
13 to the Commission on June 13, 2006. The Notice ot Opportunity of Hearing, dated May 23,
14 2006, and signed by Victoria Chamberlain, Executive Director, stated:

15 ' "You, Troy Randolph Meling, are entitled to a hearing on the proposed action of

6 the Commission. it you want a hearing, you must file a written request for a

‘ hearing with the Commission within 21 days of the date of this notice. Attached

18 to this notice is a copy of the procedures, right of representation and other rights

19 of parties relating to the conduct of a hearing as required under ORS
20 183.413(2).”

22 Mr. Meling did not request a hearing. The Commission, therefore, finds
23 Mr. Meling to be in default and enters the following findings of fact, conclusions of law
24 and order, based on the files and records of the Commission concerning this matter.
25 FINDINGS OF FACT
26 1. Mr. Meling was originally licensed by the Commission on July 3, 1990.
27 Mr. Meling currently holds a Standard Teaching License issued January 21, 2004, valid until
28 February 16, 2009, with a Basic Social Studies Endorsement.
29 2. Mr. Meling began employment with Gresham Barlow School District as a licensed
30 teacher on August 31, 1998. On December 10, 2004, Mr. Meling resigned his teaching position

It! in lieu of termination.

.1 3. On December 28, 2005, Mr. Meling was convicted of Possession of Child
2 Pornography in the United States District Court. The court fined Mr. Meling $12,500 and
3 sentenced Mr. Meling t0 a flve year probation with special conditions.
4 CONCLUSIONS OF LAW
5 Troy Randolph Meling’s conviction oi‘ the Federal crime of Possession of Child
6 Pornography, 18 USC § 2252A(a)(5)(B) and 2252A(b)(2), constitutes Gross Unfitness as
7 defined in OAR 584-020-0040(5)(c). The Commission has the authority to impose discipline in
8 this matter under ORS 342.120 through 342.430 and OAR Chapter 584.
9 FINAL ORDER
10 The Commission adopts and Incorporates herein the above findings of fact and
11 conclusion of law, and based thereon, hereby revokes the Standard Teaching License issued to
12 Troy Randolph Meling.
